Bidvest is the worst insurance, do not insure with it
3. On or about the 23/04/18 I drove from Midrand to kzn. I Noticed the red warning light on my dash board. I proceeded to call my insurance ( Bidvest) when I arrived home in Ulundi, Mahlabathini. On or about the 24th of April 2018 Vish Moodley was called in tow the vehicle and he also advised me to tow the vehicle to a bigger town " Empangeni". I re**** on his advice as I believed that he was an agent of the insurance and I did not enter into a contract with him. As a result of the vehicle being booked in at Empangeni the following issues arose: 3.1 Mr Moodley towed the vehicle to his own repair centre 3.2 on or about the 25/4/2018 Mr Moodley was requested to give the reason for the breakdown of the vehicle by the insurer. 3.3 on or about the 26th of April Mr Moodley advised that he did not have a historical background of the vehicle to determine whether the vehicle broke down as a result of wear and tear or whether it was a mechanical failure, the email is attached hereto and marked as Annexure “A”. Further issues surround this incident which are as follows: 3.3.1 Mr Moodley advised after 5 days that the breakdown was a result of wear and tear. This would obviously indemnify Bidvest from paying the damages. This diagnosis is pecu**** in that how did Mr Moodley suddenly have a historical background of the vehicle when I did not provide it. What was the basis of this conclusion.what changed in 5days? 3.3.2 Mr Moodley advised that he would repair the vehicle for R20 000 But he claimed R35.000 With the insurance. I informed him that he needed to return my vehicle and that I could not Authorize the repairs. 3.3.3 Mr Moodley then said he wanted me to pay R5200 for stripping the vehicle and claimed that it was the cost for stripping and diagnosis. I did not agree,but he promised to do something for me on that amount. Mr Moodley promised to call me on the 03/05/18 regarding the status of my vehicle. Mr Moodley did not do so. I had to send my brother to go to the work shop to collect the vehicle but he could not get the vehicle.all attempts in retrieving the vehicle were futile. 3.3.4 on the 4/05/2018 I took the matter to the South African consumer complaints. The mediation started that took about three months with South African consumer complaints but not resolved in my favour. It was decided that Mr Moodley was not registered with the motor industry ombudsman but for some reason.It was taken further to Motor industry ombudsman and also short term insurance ombudsman and it took another 4 to 5 months, the verdict which was delivered on the 5/12/2018. The conclusions are annexed hereto as Annexure B and C respectively. 3.3.5 it is important to note that During October 2014, members were advised that the Motor Industry Ombudsman of South Africa (MIOSA) and the South African Automotive Industry Code of Conduct (Code) had been accredited by the Government, Department of Trade and Industry, on 03 October 2014. The Code was published in the Government Gazette on Friday, 17 October 2014, Notice 817, Government Gazette No. 38107(3) and through this process the Code became a formal Regulation of the Consumer Protection Act No. 68 of 2008. The Code also deals with the compulsory funding (legal requirement) of the MIOSA and in this regard all businesses in the Automotive industry are now legally required to register with the office of the MIOSA and pay the required levy. I trusted that the dealership that Bidvest would authorize to repair my vehicle would be a place that is reputable and legal. I did not expect my insurance to not follow the law. I trusted that they would do the necessary research . 3.5.6 it is evident that Mr Moodley is running a business that is not legal and Bidvest supports such a business which is alarming As I entered into a relationship of trust with them and they broke that. Upon this knowledge I terminated my contract with them. Mr Moodley is now claiming storage fees amounting to 62 000 as well as an amount of R5200 for stripping the vehicle, he also informed me that he could sell the vehicle on my behalf to cover the cost. The vehicle was not abandoned at Mr Moodley’s warehouse. I have a constitutional right to be heard where I feel aggrieved and that was why I seeked recourse. In terms of Section 15 of the consumer protection act please note that it is stated that 3) A service provider to whom this section applies must not charge a consumer for preparing an estimate required in terms of subsection (2)(a), including— (a) any cost of performing any diagnostic work, disassembly or re-assembly required in order to prepare an estimate; 4. Please note that correspondence between Mr Moodley and the SA consumer complaints indicated that Mr Moodley could not charge storage costs for the period of mediation. Mediation only ended on the 6/12/2018. (Annexure c). 5. Furthermore in the month of January Mr Moodley's offices began negotiations with my attorney and they have since ignored the fact that I have attorney on record and made direct threats to me. 6. I have been informed that my radio was ******, the car will be auctioned. 7. Bidvest has done nothing to assist in this regard
