MIsled by Maverick

Since 2012 I have had a contract for uncapped Internet through Maverick for MTN. I get throttled at 3GB.

In 25 April 2017 I was phoned by Adrienne from Maverick and asked if I would be interested in a contract where I would be throttled at 5GB for R199 a month or R299 at 10GB. I asked if it would still be uncapped. She stated that it was “unlimited” and she would send through the contract that afternoon.

I only received the contract on 26 April and as it did not state uncapped I phoned her and she again assured me that it was uncapped, stating that my previous account with them had also not stated uncapped, which was true.

I signed the contract and sent it through and within minutes my internet was cut off.

On phoning I was told I had already used up the 10GB that was allocated to me. I stated that it was meant to be uncapped. I phoned them that same afternoon however the internet stayed off. The 27th was a holiday however on 28 and 29 April there also was no telephonic response from Maverick when I phoned them. On 2 May I received an email from Adrienne stating:

“Your request has been submitted and it will take up to 72Hours to go back to the same old 3GB uncapped package you have had before. Your USD code is ********** .

You have asked if your bill will still be the same, Yes it will, however you have received 8GB of Data when I loaded the upgrade you might be billed for this but us as Maverick will compensate that bill so when you receive the statement on the 20th of May we will have a look and whatever amount you have been billed extra for Maverick MTN will compensate for it.”

To date I have had no internet again. Last weekend Carmen gave me a voucher for 3GB however I do not know if I will be billed for that. I have never received a bill from Maverick nor MTN in 5 years.

When I phone now they just state that Carmen, who gave the voucher, is busy on the line with MTN. I have phoned numerous times.

The 10 GB contract should have been cancelled due to misrepresentation (per Consumer Protection Act) as Adrienne said she had 7 days to do it but they were not working over the long weekend. I should not be charged for the 10GB used because I was on uncapped and not be charged for the 3GB voucher. As I pay R314 a month from 20th to the 20th of the next month I need to pay only for 5 days of internet from 20 April to 25th May unless my i uncapped internet is switched on. This is scary as I pay via debit order and they can deduct any amount. There is also a R150 upgrade fee. The upgrade date on the contract was also only 20 May 2017.

On 5 May I set out the situation in an e-mail to MTN customer Care however have to date had no response and no internet since 25 April.
