Repudiation of claim and unfair treatment
In August 2019, I had a mechanical breakdown and VW quoted over R74 000 and M-Sure only paid R12 000 towards the claim which is their limit for engine components. I ended up buying most parts out of my own pocket just to get the car back on the road again. To cut the long story short, I got the car back after 2 months of waiting. Everything was perfect about the car and the service I got from VW was excellent, beyond my expectations as usual.
On the 20th of September 2019, I had another breakdown due to a sudden noise coming from the engine bay and the car had no power. So to prevent further damages, I had to request a towing. Car went back to VW and I was informed that the timing chain has failed and apparently it stretched. If I had driven the car any further, it would have damaged the engine. They submitted a claim again to M-Sure because the timing chain is a covered component on my policy. M-Sure declined the claim saying that it was quoted on the initial claim and therefore cannot be covered on this second claim.
M-Sure received the invoice of the job that was done and the timing chain is not there. Their reason is that I should have taken all steps possible to keep the vehicle in a proper and efficient state of repair and not misuse the vehicle. Proper and efficient state includes preventative maintenance. And that to me is a vague statement because the car is serviced and maintained at regular intervals according to VW specifications.
So my argument is, what preventative maintenance I should have taken because the car was on the road for over 750km before this second claim. So meaning that this is a valid claim of a covered engine component and they are trying by all means not to pay the claim.
M-Sure policy wording states clearly that Mechanical Breakdown Or Electrical Failure means, for the purpose of this policy, the breaking or burning out of any of the components listed in Components Covered, due to a mechanical or electrical failure that causes the component to suddenly stop functioning, needing repair or replacement, it is covered. And it is within my rights then to submit a claim. There is no mention of the amount of mileage you should travel before you submit another claim. There is also no mention that should the part be quoted, you cannot claim for it again until you replace it yourself.
