Terrible management who can't care less about OWNERS, but rather about tenants!

I am the owner in Baldersani Unit, have sent 6 complaint about the noise nuisance we had with neighbours downstairs (tenants) since November last year. According to my lawyer the penalty was supposed to be imposed after the first complaint, I have sent 6, had to chase them every time to get some answer from them, now my lawyer is involved , but still same story, they keep running away like kids from their duties, don't respond to lawyers or mine emails. Every time my lawyer calls they ARE NOT AVAILABLE and promise to call back, but funny enough they never DO! The most disgusting attitude I ve ever received from body corporate. Dealt with Shirley and Michelle.

Dear Evgeniya

Thank you for the complaint above although I am not quite sure why you feel that you needed to escalate your complaint to social media as this will not change the channels that we need to work through.

We received your first complaint on the 20th November 2018 to which we responded to on the same day requesting the unit number of the offending unit which you undertook to provide us with later that day and never did.

We then received a further complaint on the 7th December 2019 to which we again responded to the same day requesting the unit number, that you then provided us with.

A letter was then addressed to the Owner of the said unit regarding the noise disturbance.

When we received the next complaint on the 18th April 2019, a second letter was addressed to the Owner in this regard on the 21st April 2019 and a further letter dated 6th May 2019 following a subsequent complaint.

We have answered your emails and received your letters from your lawyer which I noted to you was an unnecessary expense for you and not necessary as there is a means of relief which is following the proper channels and that is through the Sectional Titles Ombud.

Unfortunately, there is a process to follow and this we are doing. We need to do three warning letters to the unit that you are complaining about and if the letters are not successful in sorting out the complaint, then a meeting with both parties and the trustees needs to be held which we are trying to organise currently - which was also communicated to your lawyer today by Shirley.

It is also to be noted that it is a difficult complaint to deal with as you are the only complainant and no other owners are complaining which would give the case more weight.

Please note that the matter is in progress and we have no control to stop the noise unless you go legal directly against the Owner in question with whom you have a complaint against or you take the issue to the Ombud for them to rule - managing agents have no power and can only follow due process.

We are trying to resolve this for you by following the necessary channels.

 Many thanks
