Outstanding Arreas
I had outstanding arrears on my levies and made an arrangement to pay the levies on the 31st of the month. The payment was made and the agency handed over my account anyways 3 days later. They accrued R2000 worth of lawyer's fees as a result.

Prior to that I had countless arguments with Michelle regarding her conduct in assisting people with arrears, and
I would really like her to change her approach and assist as the objective is to get the levies paid and I do not want her negative attitude towards people who owe levies result in my account being handed over

After they realized the payment was made they removed the amount owing and left the lawyer fees. I have sent Lumic and the lawyers numerous requests to remove the lawyer's fees from my September statement before I settle because the matter has been unresolved for 2 months and the response I got was that if I don't settle the September levies and lawyer's fees I will have more fees accumulating on my account.

\An owner shall be liable for and pay all legal costs
Dear Boitumelo
Please note that your account has been in arrears since 2013. It was noted that the account had already been handed over to attorneys as the amount outstanding was far too large to not take action on. It was noted that if you paid legal action would be stopped but unfortunately no payment reflected on your account due to you using an incorrect reference number and therefore the payment not being picked up. Lumic work under instruction of the body corporate on how to collect debt and when to hand non paying owners over for legal collection. I find it very hard to believe that you can bring my company name into disrepute with a posting on Hello Peter when you are at fault for not paying your levies and not even meeting with your trustees to make payment arrangements and only to kick up a fuss when the account is handed over after not paying levies for months and still not having paid your levies up to date and having the rest of the owners in the complex pay for your amenities. Unfortunately if you read the Sectional Titles Act it is correct that the owner is responsible for the legal fees and these will remain on the account & the account needs to be settled. Michell
