KING PRICE 3RD PARTY CLAIM

My son was driving on a main road and this young girl reversed out her driveway and didn't even see my son and drove straight into him. Damaging both doors and the mirror. We aren't insurance and her father put a claim through on his insurance King Price, after sending through all the pictures and documentation ect.... a month a half later they come back with a offer of R11 to fix it and we got quote cheapest was R35. How disgusting is that, i feel whoever is with King Price should relook at them. Very disappointed in there service and offer disgusting.

Please remember that a third-party claim is considered a legal claim and is not a normal insurance claim, thus legal principles are app****.

To determine what the client is “legally responsible” to pay for, consideration needs to be given to the obligations placed on a person in control of a vehicle traveling on the public roads as derived from the principles contained in the Law of Delict. In accordance with these principles the action of each party involved in any specific incident (irrespective whether they had right of way or not) is measured against that of a reasonable person under similar circumstances. Should the person’s action in the incident deviate from the action of a reasonable person under the same circumstance, the person’s action is seen as negligent.

Negligence may be deduced on a balance of probabilities from the circumstances of an occurrence.
The action of the “reasonable person” is described in the “Motor Law, Law of Third Party Compensation” by HB Klopper from which we quote:

“The standard used to judge the conduct of a person is that of the reasonable person or bonus paterfamilias. If the principles of negligence are app**** to a motor vehicle accident, the court places itself as far as is possible in the place of the driver at the time of the accident. The conduct of the driver is then compared to that of a reasonable person under the then prevailing circumstances. A driver will be negligent if a reasonable person/driver would have acted differently if the damage caused were reasonably foreseeable and preventable.”

Therefore in this instance an apportionment was app**** hence the reason for only a percentage of the claim being approved.

Considering how the accident occurred our legal team are of the opinion that this is a fair and reasonable offer.

Thank you for your response.
What i cant understand is your draw up a quote on the vehicle when you haven't even sent out the assessor to see the vehicle and quote R265.00 per hr for labour, which is not heard off.
There are a few more things on the vehicle that where damaged that wasn't on the quotes your received as we were trying to keep it to the lowest amount. Please explain to me how you want us to repair doors that is not repairable.
You stating that we are liable for 30% and you 70% but your payout is less R5k as per your quote i dont understand.
Regarding the 30%, please can you justify us having to pay it as i was driving on a main road and your clients daughter was reversing from her yard with no fence and instead of braking she accelerated straight into me where my girlfriend was sitting as she was in a hurry to get to the dischem before it closed. When a person T hits you, where are you suppose to go as there are cars driving on the other side of the road?
You are stating that this is a fair amount to pay which isn't even half the amount of our quote how will i be able to fix the car for the amount you have offered me, unless, as per your quote maybe you can fix it for the amount of your quote you have given me, as you see it?
Please re-address your calculations of your offer as its still incorrect!!!!!!!!

Please can you send me your rules of your 3rd party claim as i would like to see where it is the law that you take 70% off the quote and then another 30% off and pay the difference. So what happened to the 30% from the 70%? Please send me your rules and regulations for 3rd party claims i would like to approach legal advise. Also if your client has admitted to hitting us why are we responsible for 30%??????

Oh my hat now listern to this, we are trying to accept the terrible quote they have offered. My son left for the UK begining of March and i asked if they need anything before he leaves FOREVER now KING PRICE WONT PAY US OUT because they want my son to go to get an affidavit in the UK from the police who dont even have my original ID and refuse to do it, i have given them my proof of banking details as im the one that must fix this vehicle that is standing in the garage since February. We have tried to consider the request favourable and regrettable we can’t do much.
Third party claim is a legal claim it has legal consequences and its remedies in this situation we will not be able to process the payment if it lacks the supporting documents it requires.
So please explain to me how we suppose to get an affidavit in the UK for them to pay the money into my account????? PLEASE DONT EVER USE KING PRICE THEY WONT PAY YOU YOUR MONEY
