insurance refused to pay for my claim

On the 19 of June i was involved in accident,someone just drove to me and hit my car when I was packed out side of the road and get off from his car and run away, i reported the accident immediately,police came and wrote accident report .nw the insurance refused to pay my claim because i made my mother the regular driver of the car And at some point i drove the car more than her days ago so they say i should have been the regular driver for the car not her.nw is beyond repair.
