How third party claiments are treated
I was claiming from king price as a 3rd party. It took me approx 6 months before I finally received a decent settlement figure. The first 3 weeks of my claim I was told that they could not reach their client to confirm my claim. After dropping of the letter of demand to their client I get a call from king price stating they will only settle me Approx R1300 for replacement door and fender as well as panalbeating to the rear fender of my Nissan 1400 pick up. When asking why the figure is so low I got told that the RETAIL value of my vehicle is R3000 something as it is a 1985 Nissan 1400 code 4. Retail meaning I can buy one in running order for that price. When I asked the consultant to find me one at that price I was told it is not his job. So I continued taking the client to court. Once the summons got dropped off at their client. King price phones me to tell me that they have reviewed the value of my vehicle and are willing to pay out R9000 which is a reasonable amount. But while going through the process I was made to feel bad as they kept throwing it at me that their client is 85 years old and can't go to court, that's the only reason they paying me the final settlement amount. I was utterly disrespected by the consultants who were handling the claim. Imagine being payed appropriately R1300 when just the new door and fender cost R3500. That is beside the panel beating and spray work needed. N to be told on top of that, that because my vehicle is registered as a code 3 it was rebuilt from the chassis up. There is more than 1 reason for a vehicle being a code 3 and there wasn't even an assessor sent out to check the vehicle. So they were going on assumptions
Why should one go through such an ordeal when one was not at fault in the accident.
