2400 compensation from king price for 2400 third party.

This is king price justifying 2400 as compensatiom for a 106k car. Their client jumped the robot and almost killed me. Good Morning Desmond,

Kindly note a third party claim is a legal matter which will be settled based on legal principle. We have made an offer to you because we are aware that our client is the more liable party.

Our client however is not 100% liable for your damages. The law states, as long as 2 people were in motion, both parties did contribute to the accident with one person being more responsible for the accident.

Nkosinathi would have looked at the incident location as well as the damages caused to both vehicles. The only time you will ever receive a 100% offer as a third party, is if our client collided into the back of your vehicle while travelling behind your vehicle or if your vehicle was parked and he collided into the parked vehicle.

A person traveling on a road (even if he has right of way) must at all times act as the reasonable person considering that he is traveling on a public road on which an assortment of dangers could occur. A person is not expected to act paranoid but he is expected to be vigilant and to keep a reasonable speed under the circumstance. A person’s failure to act as a reasonable person under the circumstance is seen as negligent.

Keeping a proper look out means more than looking straight ahead – it includes awareness of what is happening in one’s immediate vicinity. A motorist should have a view of the whole road from side to side and, in case of a road passing through a built-up area, of the pavements on the side of the roads as well.

We cannot offer you a 100% of your damages. Both parties were in motion at the time of the accident therefore the matter has to be apportioned.
