No feedback and still no phone

I asked my mom to buy me a phone and she came with those VERSSED Motion E1 tablets from Phumlani Mall in June 2015. A month later the charging port stopped working and the top part of the screen also wouldnt function so she took it back along with the receipt almost a month ago. She was promised she would be called when it was ready. 5 weeks later my phone still isnt back so on 15.09.2015 I called Sibongile who said she would check and call me back, she didnt call me back so I called again and Sibongile said to me that she was waiting for Sibusiso to get back to her as he was on lunch. That was 2 days ago and this morning when calling Phumlani Mall Jet Mart the phone just rang unanswered giving me the impression i am being avoided. Maybe they have caller ID. Please can i either have my phone back FIXED? if it cannot be fixed then give me a new one OR give me a full refund. Money is a scarce commodity but my patience is scarcer.
