Jet cellphones are sold broken

Purchased a phone from Jet as a gift for someone. Handed the gift to the person 10 days after the purchase. The phone is faulty and Jet refuses to refund me. Instead they want to send it for an assessment which could result in a repair. This is completely unacceptable. How do you buy a new phone but get it repaired before you can even use it.
