Unfair practice
I took out a service plan (B ********** 668) with McCarthy Woodmead administered by IUA business solutions it was to commence on 60000.00 kms. I took my car for its 60k service when the millage was approx 61k in March 2017 When i recently brought it in they advised me that my plan expired feb 2019 not March when i queried i was told that it had been adjusted. I spent over 2 weeks trying to sort out via McCarthy only to find out that i had to deal with IUA. when i queried IUA regarding the rejection of my claim they advised me that it had expired. i then queried them stating the following: • Please advise where and how you came to date of 17/02/2019 as no communication was relayed to yourselves regarding when I reached 60000 KMs exactly • If it is based on an average calculated between the last two service intervals please advise where in the policy this practice is stated, • Thirdly please provide me with proof that you corresponded the amended activation and termination date to myself as I have no record whatsoever of this being done
IUA responded by attaching my contract etc stating my expiry dates and what it covered blah blah. they did indicate via screenshot that they did use an average to work out the date however they did not answer any of my other questions.
Firstly i am not an IDIOT i am fully aware the contracts validity periods however the issue at hand is the following.
No where on the documentations sent to me including my contract does it specify how you will calculate when the 60000 commencement date and nowhere was I adequately informed of such You nor McCarthy have no record advising me of the commencement date and I again state that this is unfair practice, your policy document clearly has a section “my responsibility” and no where does it state my responsibility is to determine when you determined the commencement date started, should you determine a commencement date based on a calculation not indicated in the contract then it is YOURS or McCarthy’s responsibility to advise me.
By not advising me within the contract or via correspondence of any amendment of activation date or how it would be worked out IUA have not made it possible for me to make an informed decision on when to take my car in to ensure i get what i paid for. by not advising me of all aspects of the policy either within the contract or by correspondence they are in breach of the consumer protection act.
I request that this be sorted out timeously as it has been dragging on for over a month now and it takes your complaints department over 2 weeks to respond failing you being able to sort out the above i will report it to the ombudsman.
