Managing agent being vindictive.

I sold my apartment in a complex, largely due to the managing agent infringing on my rights as an owner. He became very nasty towards the end and i was prejudiced against by Faizel( owner/ manager of IMZ). In April/ May this year, my apartment was treated for damp at the body corporate's expense for the 3rd time in 12 months. All due to the managing agent (Faizel) not ensuring that the work was done properly the 1st and 2nd time. The last job was done deliberately at a slow pace as per Faizel's email to his staff. All because I requested that he does not communicate with me directly, but rather his staff only to communicate with me. He kept on sending me nasty emails. The last job was done when the unit was empty. Faizel(Imz) refused to accept the utility bill for that period as part of the repair cost. The damp contractor used water and electricity. Transfer took place 21/05/19 and there is a credit due to me. Faizel(IMZ) has made it clear that I will only be refunded when I agree to his total which excludes the utility cost as consumed by his contractor. The transfer attorney has sent them a letter, which has been ignored.

I had to seek intervention from CSOS to get my refund from Faizel(IMZ). That was 4 months after registration. I was refunded without interest on my levy that was in credit for 4 months.

Clifford had damp in his unit. 

The Bc agreed to pay for the remedial work, to undertake the work the contractors required to use R60 of electricity.

Clifford refused to pay for this, trustees also
Agreed it should be paid by Clifford.

As managing agents we are unable to authorize any payment unless instructions to pay is approved by trustees.

This dispute delayed paying out the refund to Clifford following his transfer. Once the trustees had confirmed IMZ could release the payment to bring closure to the matter, full payment of the credit on his account was settled.

A good managing does not transfer funds without approval, money held in a bc account does not belong to the managing agent and unless approved by trustees, we will not pay out funds which do not belong to us.

IMZ has been operating since 2009 and have become a strong leading managing agent in the areas we work in. Our service, experience and knowledge in our field speaks volumes. We do take all complaints seriously, however although we are the main communicators with the residents, it’s not us that are decision makers.
