Imperial Select Multi Franchise Legal Advice & Help Needed Urgent

<p>Good Day,</p> <p><br />I bought a Citroen DS3 1.6 Thp Sport, Second Hand/ Used Car at Imperial Select:Multi Franchise in Nelspruit Mpumalanga which I have put down a R20,000 deposit down and pay a monthly fee R3000 + R1500 for insurance I have paid an estimated R45,000 so far on the car regarding Deposit, Insurance and Monthly Installments, I still have R195,000 left to pay for about 5 years.</p> <p><br />The Car had Numerous Problems since I bought it it’s been about 5 Months its been to Sebenza PanelBeaters about 4-5 times and been to Citroen twice, I have taken it back and every time they fixed it for a while but now I am fed up with this ongoing hell of an issue.</p> <p><br />The Turbo went, Apparently the engine valves also went, The entire tappet cover seemed to also be broken leaving the entire engine with oil and the salesman at imperial even told me it's normal, The reservoir tank was broken, The vents are broken still awaiting the parts apparently and now the high pressure fuel system also went.</p> <p><br />The Car is now left collecting dust in my garage as it's a boasting R17000 to fix I have tried claiming from warranty before re-approaching the dealer but the worst is they only pay R3000. They also have sold me this warranty which they have said to me it pays for any faults on the vehicle but of course that was a Lie.</p> <p><br />Now I have come to the point where I want a full refund on the vehicle and I have approached the dealer once again which he told me he cannot help me as they only have a 30 Day warranty on their vehicle’s or a 1000 KM's funny thing is I haven't even drove the vehicle for a month or nearly a 1000 KM's regarding all the faults and issue’s.</p> <p><br />I have been struggling for 5 Months regarding transport to work and so on been left stuck next to the road missing work and all sorts of crazy things, I have had a very bad experience with Multi Franchise and Imperial Select and I wish you do something about it.</p> <p><br />I wish a full refund on the vehicle or another vehicle that suits my preference or to fix all damaged internal engine parts.</p> <p><br />I have now approached a Legal Facility and Various Ombudsmen regarding this problem as per the Consumer Protection Act No.68 of 2008.</p> <p><br />The Consumer Protection Act No 68 of 2008: (CPA): Warranty Protection: Second Hand Cars:</p> <p>The Consumer Protection Act No 68 of 2008 came into operation at midnight on the 31st March 2011; and has been the law since that date.</p> <p>The CPA states that an official car dealer may not now sell a vehicle voetstoots, irrespective of whether they disclose what’s wrong with it or not. A vehicle can be sold voetstoots or “as is” only in a private sale; but that still does not mean that the buyer is left high and dry. In order for a car to be validly sold voetstoots; a full list of all known defects has to be provided to the buyer by the seller. You as the buyer would then in the sale agreement have to sign and acknowledge the presence of those defects. Any defect outside that list is not covered by the voetstoots clause. If any defects are discovered with six (6) months of the sale you have the right to insist on repair, replacement or a refund.
