Breach of Contract
I would like to share an email I sent to IGrow last week Wednesday that was ignored. hopefully they will have a decency on responding in this platform.
Good Evening
I would like to express my displeasure at the current set of circumstances. I pay rent monthly on time with no hassles and my understanding was that I was signing up for a flat or accommodation with set creatures comforts at a rental amount of R6900 monthly, namely a stove, a bathroom, two functional bedrooms, a lounge, kitchen with built in cupboards and secure parking bay.
To date I the tenant live up to my end of the contract and the landlord is not. I say this because it has been five months and in this time whilst I pay in full, the flat was incomplete as I had to take time off from work so that the rest of the cupboards and extractor fan would be installed in the kitchen.
To this end the cupboards were installed but the extractor fan has not been installed, a creature comfort that I have been paying for for the last five months.
Secondly, when we moved in I sent an email highlighting features such as curtain and towel rails that came loose and a broken light switch in one of the rooms. Once again I had to take time off from work to be at the flat for these to be fixed. The rails were fixed but for the past 3 months or so we have been icing without a creature comfort of a functional light in one of the bedrooms.
Thirdly I had to allow a resprensentative to come and take a meter reading for the water, this was followed by me having to once again avail myself for the installation of a device which would allow for the water to be read remotely. This was to aid the billing of water usage. Once again as the tenant I receive the bill for water and on a principle of trust I settle the bill for water used no questions asked and no hassles on my side.
Now I get a email detailing an error in the water bill where I have been overcharged. This raises question to me as to whether how do I trust the water bill going forward if I am not able to verify the authenticity of the method used to get to what I have to pay for water used.
I am really frustrated at all of the above and ask that as the landlord who has a paying tenant without any hassles or incidents keeping to the set agreement, that the landlord live up their part of the agreement. I hope that as I exhaust the channel to voice my grievance you will treat it with the seriousness it deserves.
Lastly, there are a number of issues that need the attention of the body corporate, but as things stand we don’t seem to have that support system in place. Our main gate has been open for the last four days which is a serious breach in a secure complex(functional electric fence, entrance gates and 24hr security on site) that I opted for and pay for once again as per set agreement or contract.
