Please shed some light, My husband has been granted a loan to buy a car, under instalment sale agreement, I would like to bring to your attention that we are married in community of property and my consent was not obtained in this instance, I’m sure as a financial institution you are aware that this current debt you are creating it’s going to affect me and I was not informed none did my consent regarding this agreement has been obtained,

I need this contract cancelled immediately, His credit record cleared immediately of any footsteps left on his profile, You did not follow the processes of NCA, Should you fail to do as per my request, I’m going to lay a formal complaint with National Credit Regulator and this debt will be regarded as void, I’m going to give you 24Hours to confirm this transaction has been cancelled, Failure thereof you leave me with no choice but to take this further, And trust me I know my rights and you really don’t want to try me because I will drag your company to court!!! Hope this will remind you of your obligations in terms of the law.

Applying for credit under the NCA has changed in the following aspects: • The spouse of a person married in community of property must consent in writing to the undertaking of a loan agreement. Previously, this only app**** to credit agreements such as instalment agreements and leases.
