Refusing to pay for items under warranty.

My vehicle was brought in for repairs at Hyundai Sandton, following the fact that my vehicle started experiencing difficulty in motion when changing in between gears.

I was informed by individuals at Hyundai Sandton that my vehicle no longer had a clutch.

I have spoken to various individuals at Hyundai Sandton who informed me that Hyundai South Africa refuses to cover my clutch plate under warranty. Upon calling Hyundai South I was informed that my clutch plate is not covered under warranty because it is a wear and tear item.

The vehicle was purchased early this year (2018). This means the period of one year has not passed. Further the vehicle has not exceeded 20 000 KM. Thus it is within the parameters of the Warranty.

Section 2 of the Hyundai Warranty states circumstances in which the Warranty shall not apply. It is stated that the wear and tear has to be normal in order for it to not be covered. A mechanic at Hyundai Sandton and an employee at Hyundai South Africa both conceded that it is not normal for a clutch to wear and tear in 4 months. Both conceded that it was abnormal.

Further section 3 of the warranty states that the clutch and pressure plates are covered under warranty. Under section 8 of the Warranty which is entitled "Maintenance and Service" section 8.9 states that "Clutch and friction materials and surfaces are subject to wear and tear, requiring periodic replacement and adjustment and is warranted for a period of 1 year or 20 000 km". this clearly indicates that the clutch is warranted for a period of a year or 20 000Km.

In light of the above information I requested to speak to the warranty manager and was denied the right as I was informed he does not speak to customers. This is appalling service from Hyundai.

I asked for an indication to me in writing why my clutch plate is not warranted in light of the above and was informed that "Warranty stands by their decision to not honour the warranty claim to replace the clutch As discussed yesterday , warranty only covers parts that have failed due to a manufacturer defect not driver abuse. The dealer confirmed that failure has resulted from excessive heat to the clutch plate , which has resulted in the clutch friction material to sheer off. Excessive heat is caused from severe clutch strain , poor driving style or customer abuse."

I have not been shown where this appears in Hyundai's warranty policy.
