Edenvale Hyundai are responsible for Misrepresentation and False Advertising

<p>In June I purchased a car from the Edenvale Hyundai Dealership which was advertised as a Demo Model driven by the Dealer Principle</p> <p>“ex Demo driven by our Dealer principal in excellent condition , no marks or scratches , no accident damage”</p> <p> </p> <p>I received the car in the first week of June and immediately complained about the terrible cigarette smoke smell in the car.</p> <p> </p> <p>Since purchasing the car I have been on an inhaler and antihistamine as I am allergic to cigarette smoke.</p> <p> </p> <p>I purchased a car that was advertised as a demo model driven by the dealer principal and that I have always understood demo models and company cars are not allowed to be smoked in. ( I have copied the details of the sale below so you can see for yourself). The Dealer Principal (Drickus Botha) called me and confirmed this was a lie as he had not owned or driven this vehicle!</p> <p> </p> <p>The sales man at the time (Leon) explained to that everything would be fine once I had the car valeted and the air con pollen filters changed and I believed them, meantime this took a while to get done as we had the Fires (my sons school was burnt down) which prevented me from going into PE earlier to get this done I eventually managed to get the car in on Thursday the 22 June, and once done I left to fly overseas t for 10days (I had left the car windows open in my garage for the full 10 days) and when I came back the smell was still very evident, it still is. My cough had gone whilst overseas and was back within a day of driving in the car.</p> <p> </p> <p>It is now August and I have now been given Ruben to talk to and he says that I have the deal of a lifetime and that they can’t replace this car at this price anywhere in the country and they are certain if they take the car back to have the air con pollen filters changed the smell will go away, I can confirm it will not the smell is in the fibres of the vehicle itself and I am concerned about my health! Anyway he then once again confirmed that they had not taken my complaint seriously the first time so although they said they were going to change the pollen filters in fact they hadn’t but this time he promises I must be patient and it will make a difference!!!! another lie and another month of driving a car that is making me sick!</p> <p> </p> <p>Just to understand the background …. I did not expect to spend as much on a new car, from a Renault Duster to a Sante Fe was a big step for me and I decided to spend the money given to me by my father to purchase this A Class safe car for my son and myself, as his gift to us. In every other way the car is awesome, but I cannot alas live in the smoke environment.</p> <p> </p> <p>I am also in the business of yoga gear and have just had clients come from the UK for a week to begin negotiations to take my brand into the UK it was extremely embarrassing to drive them around in a car that smelt of cigarettes, besides that every person that gets into the car comments on the this car smelling of cigarettes, it is really that bad.</p> <p> </p> <p>I believe it was MISREPRESENTATION and FALSE ADVERTISING that led to the sale and that the cigarette smoke smell should have been explained to me, the previous owner was evidently a very heavy smoker. I also am not enjoying being **** to so frequently, I can honestly say that Edenvale Hyundai give second hand car sales men the bad reputation that they have.</p> <p> </p> <p>All I ask is fto get my car back and they can take this car back, as I can’t live coughing like this, if it is such a good deal they will sell it quickly!</p> <p> </p>
