Unfair deal

In April 2024 we bought a Toyota Agya from Hyundai Amanzimtoti. We test drived it in the town area, never accelerating more than sixty kilometers per hour and all seemed to be fine. It had low mileage and we paid by EFT for it. Because the payment was not an immediate payment, I had to make a deposit of R5000(five thousand rand) dated 27 April 2024, to secure the vehicle until the balance amount of R168 000 (one hundred and sixty eight thousand rand) reflected in Hyundai Amanzimtoti`s bank account. (Process date 29 April 2024).We collected the vehicle from Hyuandi and drove home on the N2 highway. While driving I picked up a noise coming from the engine compartment and a whistle-like noise coming from the aircon/vent. The gearbox also had a noise when you reached the speed of hundred and twenty kilometers per hour. Staying in Pennington, we stopped at Toyota Park Rynie, and the service manager took the vehicle for a test drive. He immediately told my husband that the gearbox was faulty and that it was a factory fault. We had to return the vehicle to the Park Rynie Toyota dealership the next morning. After a week of struggling to get a courtesy vehicle from either Hyundai Toti or Toyota Park Rynie, I called my insurance and was sorted. Park Rynie dealership advised that it could take up to three months to get the parts that they were waiting for, and could not just replace the gearbox. We decided that we would cancel the deal with Hyandai Amanzimtoti and went to them. They convinced us to take the other Agya which they had in their display room as they did not want to cancel the deal. Yashvee brought the vehicle to our house so that we could test drive it. My husband took it for a test drive. All seemed to be fine. We had to take Yashvee back to Hyundai Toti and sign the deal. The whole way there the radio was on and he was very talkative, convincing us that this would be a better vehicle than the first one. Driving home we experienced the same noise through the vent (whistle-like) and a humming in the engine. We stopped by Toyota Park Rynie again. The manager immediately said that he was not even going to test drive the white Agya as it has the same problem as the first A*** and he suggested we take it back to Hyundai Amanzimtoti. Which we did. I called Yashvee after I left Toyota Park Rynie and told him what the manager said and that we were cancelling the deal. They tried to convince us to take another Agya but I insisted on cancelling the deal and the salesman, Yashvee, went to his manager, Tristan, and explained to him that we are cancelling the deal and want our money back. After quite a while Tristan came to me and explained that they don't want to cancel the deal but have a better offer for us. They had a Hyundai i 10,2024 model, with mags and tinted windows that they would sell to us at R230 000(two hundred and thirty thousand rand) being a demo model. It had just over a thousand kilometers on the clock. We test drived the vehicle and my husband and I agreed that we would take that specific vehicle. When we were with Nomzamo Mntungwa, the F & I manager, I realised that the capital returned to us was not the full amount. Instead of getting back R173 000 (one hundred and seventy three thousand rand), we only received a credit of R171 000(one hundred and seventy one thousand rand) which is R1500 (one thousand five hundred rand) less. I queried it with the F &I manager and she queried it with the sales manager. Their response was that it "works like that We can not end a refund on a zero balance." I again argued that it is not fair and that I do not agree with them. Yashvee was in a hurry and just told the F & I manager that that was what Tristan, the sales manager said and left Nomzamo`s office. She turned her PC towards us to do her authorization, but we did not have a full view of the screen as she was explaining, very fast, what was on the contract. She had to finance R57 000(fifty seven thousand rand) only, which was the balance if they refunded R168 000.00 and the R5 000.00 that we had already paid. She never mentioned that they added the following items to the contract as we would not have signed. We agreed to buy the vehicle (i10 Hyundai 2024) with the mags and the tinted windows already on the vehicle. An amount of R1300 (one thousand three hundred) licence fee, service and delivery R5 500(five thousand five hundred rand) and R3 000(three thousand rand) window break in protection was added to the bill. An extra amount or R9 800 plus an amount of R1 207.50 Initiantion fee(vat inclusive). We also paid for the registration of the first Agya which we did not have any service of. The Hyundai i10 was not delivered to us, so what would the delivery fee be for? We collected it from Hyundai Toti personally. We did call Hyundai Toti after receiving our first statement but they just said we signed for it. I feel that Hyudai Amanzamtoti has not given us a fair deal and that they were not honest. They owe us the money for the tinted windows, the mags and the shortfall of R1500.00 that they did not refund when I cancelled both Agyas. The total I feel they owe us is R9800.00 + R1500.00 = R11 300.00 (eleven thousand three hundred rand).
