Inhabitable unit - Poor service - ********* - *****

I rented a unit through a managing agency called Huurkor Hatfield Branch. They now have informed me that I do not qualify for a Deposit refund, as the last two months of the rent was not paid due to the fact that it was inhabitable because my flat burnt down.

I occupied the unit on 1 September 2022. During the first two weeks an inspection report was done and all aspects of the unit were highlighted to Huurkor. Amongst these issues were included. Leaking pipes ( kitchen sink, guest bathroom toilette , main bathroom ) these issues being the biggest as it affected my Water and Electricity bill going forward.

My stove then broke and was unusable at n the 12 October. I have a diabetic Son and needed to be able to cook healthy meals but could not do this die to the fact that the stove had been broken. Numerous emails to huurkor to request for someone to come have a look to no avail till this day.

On November 21st 2022 , the Gheyzer caught alight and the entire flat burnt out, personal items that will never be replaced including ample damage of all of the beds and clothes were burnt and damaged. Upon trying to put the fire out the unit was engulfed with water and then ended up damaging electricity points and the unit was inhabitable.

I notified everyone of the issues including Huurkor.

I gave notice at the end of November 2022 and according to my contract was a 2 month notice period. I was informed by the Building manager that the owner was going to put in a claim against the insurance to recoup the monies for loss of rent.

After I moved out my last things at the end of January , I informed Huurkor to set up a time for the out inspection. This was completed and adhered too.

I had to follow up with huurkor on numerous occasions when my deposit would be paid back. Huurkor had 20 days to refund the deposit and after following up on the 21st I was told that the deposit would not be refunded because of the two months I did not pay the rent as I did not stay in the flat because it was inhabitable due to plug points still not checked and the stove was not fixed . Not to mention the first issues from the inspection that was never fixed upon moving in.

All I want is the Deposit back so that I can buy things that were lost in the fire and use the money to put down on a new place
