Deposit refund

I app**** for a flat at cullinan with huurkor , paid a deposit of R3300 and I was supposed to move in on the 1st of March 2016 when I went to the flats I was told that the tenant is no longer moving out my agent also called me and confirmed that the person is no longer moving out they will refund my deposit back,I've been waiting for my deposit but I didn't receive it when I call my agent she says she isn't responsible for refunds I've been calling the office everyday and they now giving me a bad attitude,I received emails that I should settle the outstanding balance before the 16 th March or they will take the matter to their lawyers...how am I suppose to pay march rental because I never moved in to the apartment all I need now is my deposit back
