misleading advertising

while we were looking forward to the activity of scooter riding, the tour unfortunately did not match the description provided on the website.

They advertised and stated that the routes were "easy to navigate" and suitable for "anyone who can ride a bicycle". However upon arrival, the terrain was much steeper, bumpier, and narrower than expected. this resulted in several of the group members not being able to participate as advertised: as a result, the service provided was not as described and was not resonably suitable for the participants, despite their assurance that it would be easy and family friendly!!

they refuse to give a refund for the participants that could not even manage to ride and they ignored the consumer protection act that they failed to compile, under section 41, 17, and 19 about misleading and deceptive representations and the supplier failing to provide as described.

instead of saying sorry they were defensive and non profesional in assuming responsibilities for their clients. the cost was also ridiculous, we did another adventure in 4x4 the next day for half the price. this were just normal non electric scooters, so the cost is ridiculous.

  • Prior to confirming your booking, you were provided with the official product link and a photo, which describes the activity as a downhill, non-electric scooter tour. You never requested electric bikes or scooters during the booking process.
  • Your booking confirmation and voucher reflected the same details, and indemnity forms were completed before the activity.
  • The activity was available and delivered in line with the advertised description by the operator.
  • We have also noted from your own messages to us that several members of your group thoroughly enjoyed the activity, and that only certain individuals found the terrain more challenging than expected.

It is important to note that the Consumer Protection Act applies when services are misrepresented or not provided. In this case, the service was delivered as described. The decision of some participants not to continue was due to personal comfort and medical considerations, which fall outside of our responsibility and were not declared at the time of booking nor on the indemnity forms.

While we understand that some members of your group found the terrain more challenging than expected, this does not constitute misleading advertising or non-delivery under the Consumer Protection Act. The service was provided as described and as booked.
