Complaint about Hammond Pole Attorneys and My Absa Credit Card Account
I am writing to you to express my deep dissatisfaction and frustration with my recent experience dealing with Hammond Pole Attorneys regarding my Absa Credit Card account.
To provide some context, I have an Absa Credit Card account that had unfortunately fallen into arrears. As a result, this account was handed over to Hammond Pole Attorneys for resolution and collection. My experience with Hammond Pole Attorneys has been far from satisfactory, primarily because they seem to take no responsibility for their actions, which has caused me significant stress and inconvenience.
In the initial stages of our interaction, one of their consultants offered me a settlement deal to resolve my outstanding debt. I agreed to this offer, with the condition that the payment could be split over five months (the consultant suggested this), making my monthly installment approximately R1253 for five consecutive months. This agreement was made over the phone, and I was assured that it was recorded by Hammond Pole Attorneys.
To my dismay, after approximately four months of making these agreed-upon payments, I started receiving emails from Hammond Pole Attorneys stating that I had not paid them and inquiring about when my payments would commence again. Perplexed by these communications, I responded to them with evidence of my payments, as a reply to their email they sent saying no payments had been received . I expected this matter to be resolved promptly and without further issues, given the recorded agreement.
However, it appears that Hammond Pole Attorneys initially claimed to have received no funds from me when confronted about the agreement and payments, they denied having made the arrangement and insisted that there were no payments made on my account. Upon further investigation, they acknowledged the existence of the payments and the agreement, assuring me that I had just one more month to pay, and the matter would be considered settled. I requested written confirmation of this settlement, and while they promised to send it, they never did.
It was this ongoing lack of transparency and accountability that led me to cancel the debit order, as I began to feel like I was involved in a potential ****. Today, I received a phone call from Hammond Pole Attorneys, and I tried to explain my situation, as I had done with numerous others before. However, the lady I spoke to denied any wrongdoing by her company and even asked me who had made me the offer in the first place, insinuating that they would never make such an arrangement. She suggested that I should have taken the consultant's name. That is not possible seeing as you never speak to the same consultant twice how are you supposed to keep track and the phone calls not recorded for quality and safety purposes? OBVIOUSLY NOT!!!
This situation has now reached an impasse because I had agreed to a settlement that Hammond Pole Attorneys offered, but they initially had no record of my payments, then had no record of the settlement, and finally found the record of the settlement but failed to send a confirmation letter.
I am seeking answers and resolution to this matter because I am not willing to pay these individuals another cent, as they are coming across as highly unprofessional and, to say the very least, questionable in their actions.
I have continuously requested that they review their recorded conversations to confirm our agreement, but they have refused to do so. .
HAMMOND AND POLE, Here my case number HP***, should you require this for clarification. Additionally, I intend to send a formal complaint to ABSA's Credit Department and their Public Relations Department. It is crucial for them to be aware of the unprofessional conduct and attitude that I have encountered in my interactions with you, as this has significantly contributed to my hesitation in fulfilling my debt obligations. I kindly request that all future communication be in writing, as my past experiences have revealed a lack of clarity and accuracy when it comes to recalling details of conversations between your representatives and clients. Yours sincerely, CE Marais
