Faulty products unfair practice

Hi bought 2 x Monster trucks from Homemark in Festival mall, both were not working. When i returned them i was advised they dont have any in stock to swop so i can take anything in the store to the same value. I opted for a refund as the trucks were presents and what was in-store was not suitable for kids or the same price as the trucks. I was told no refund on toys but nowhere in the store on on my slip does it indicate this. I was told new stock will come in during the week and we can then come and check if any of the trucks work. How fair is this? And phoning the customer service to follow up on what i was told in store is also a nightmare, you only get transferred from one person to the next until the phone just rings and cuts off. Worst service ever.
