Hollard trying to get my car repossessed by not paying for retrenchment cover.
Good day Hollard are a bunch of ********s; they are enablers of poverty and they are reckless when handling issues with customers as they have no regard for human issues and real life matters. I have never had such an experience in my life. Three years ago, I bought a vehicle and i was offered a credit protection plan which I was told that I am required to take up the cover as it is regulation, this is to ensure that should I lose income I am able to pay for the vehicle whilst I am looking for a new job. I was not given an option of which cover is suitable to me nor was i given a choice on which insurer I would prefer; I was told that the cover that i will be issues is the one from Hollard life. I was not given a choice. Three years later my employer decides that he would like to retrench half of the employees in his payroll. In August 2023 we get notified that the company will be retrenching between September 2023 and October 2023 or whichever month they decide to pays us out which will be our last day of employment. For sure in September, they confirmed that they will be paying us out all or leave days along with the last salary as per retrenchment letter, then sent us all required retrenchment documents including the UI-19 which is a legally binging document by law. On the 2nd of October 2023 I contacted ABSA VAF and they advised me to contact IUA which is a claims, they advised me to load a claim on their online claims platform, which after that the claim was verified and the documents were confirmed. as all is in order. The consultant continued to confirm that the cover will pay for the first three months and I would be liable to pay for the vehicle after that. This confirmed what was written on the policy documentation which was clear and understandable. At the end of October i then received an email advising that the policy had been approved. Yet they have only approved It for 24 December 2023. To my confusion i called IUA spoke to a lady who was rude and told me to read my policy's document as I was liable to pay for the car till December 2023, yet i was already unemployed and had no source of income. Well, when I got home I looked for liabilities for the claim holder there were none, were there limitations which in my situation there were none. I looked for definitions to gain an understanding which made it clear that Hollard were trying to avoid paying the premium as by the time they have to pay I wouldn't have a car to pay for. Definitions: Claim Payable Date: The Claim Payable Date means the date on which a valid claim becomes payable and is equal to the claim event date plus any Deferred Period (if applicable). Retrenchment means being retrenched or made redundant by an employer during the term of the employment agreement due to new technology, reorganization by the employer, liquidation of the employer or staff reductions as contemplated under the Labour Relations Act 1995 (as amended), and which prevents the Insured Person from earning an income from any occupation. Unemployed/Unemployment means the Insured Person suffering a total loss of income due to Retrenchment. For a Self-employed Insured Person, Unemployment shall mean the Insured Person suffering a total loss of income as a result of the involuntary liquidation or sequestration of their partnership, close corporation, company or family business, provided that this is the result of extra-ordinary factors that are beyond the control of the Insured Person. Outstanding Liability means the amount of the outstanding balance due by You in terms of the Credit Agreement as at the Claim Payable Date, excluding any finance charges, any arrears falling due on the Claim Payable Date and any interest thereon. Loss of Income Benefit (Voluntary additional benefit) • The Loss of Income provides a monthly payment equal to the Loan Instalment in the event of an Insured Person covered by this benefit becoming Unemployed during the Period of Insurance. • The benefit will be paid for a maximum period of 3 (three) months per claim event. After a claim-free period of 6 (six) consecutive months of permanent employment has been achieved, the benefit will be Reinstated for new Loss of Income claims, subject to a maximum of 6 (six) payments in total over the Period of Insurance. • The Loss of Income claim event date, as determined by Hollard, is the date on which the Insured Person ceases to earn an income, having regard to the Insured Person’s last date of active service and/or employment record. After carefully going through the cover, it came to my understanding that all the people that i spoke to are not following the policy document wording are therefore cheating me of my right to receive monthly payments as per policy wording. I fail to understand why Hollard would not want to assist me according to their policy documentation and cover recommendations and pay up the cover for the three months after the claim event date. As according to the policy document: Hollard’s liability • Hollard will not be liable to make any payment unless the premium due in terms of this policy has been received, and the applicable documentation, data or medical evidence and satisfactory proof of a claim as required by Hollard has been provided to Hollard at Your expense or if applicable at the expense of Your appointed executor or the Credit Provider. • Payment by Hollard of the benefits provided in the event of a valid claim in terms of this policy will be a full and effective discharge by Hollard of its liability and obligations in terms of the policy. In this regard I see no Liabilities that could be held against me as the one liability I can pick up in this passage is that Hollard is liable to pay benefits provided in the event of a valid claim in terms of this policy will be a full and effective. I have tried numerous times to contact the Hollard to get assistance with regards to a way forward but as I was speaking to many different people, I never received valid information that can help me. As it stands ABSA wants to repossess my car yet I have been paying for a cover that has been created to help me keep my car in event I find myself retrenched and unable to make payment due to loss of income. Hollard are trying to avoid paying for my car by approving payment of the cover on the third month which is no where in the policy documentation. They are aware that when December comes, I would not have a car and they will not have to pay the instalment for the vehicle. Hollard are intentionally disgruntling customers and lying to them when thay have to make payments for policies they have recovered premiums for. All I want is for Hollard to do what they set out to do when I took out this cover and that is pay for my car for three months as effect of the claim event date as stated in the policy wording, they have to pay for three months as of the claim event date i.e. from October 2023 to December 2023. We are human first then we are customers don’t cheat us of our premiums by creating processes that are not written on the policy documentation. Kind Regards Tebogo Seatlholo. ***
