Insurer hiding behind disclaimer-Hollard

<p>Hollard on behalf of AIV Properties are hiding behind a disclaimer for damage that occurred to my vehilce. The incident happened in July 2016 and in January 2017 advise me they are rejecting the claim based on the fact that there is a visible disclaimer. The boom gate on Cosmos View Estate in Kosmosdal Centurion closed on my vehilce while is driving throught the main gate and cauded damage to my vehicle. After 6 months of sittin with the claim they advise htey will not entertain a claim. You can sit and read the disclaimer till you are blue in the face, it will not change what happened to my vehicle. After speaking to the Estate manager he advised there have been other incidents of the same nature which he reported to the body coporate.. The insurer now wants me to prove the incidents which should not be my responsibilty. I have however requested the information from the estate manager only to be told that they have changed security service providers and the incident was recorded in the previous security company's register. A big multi million rand estate does not record incidents and then make it my responsibilty to prove negligence. By the estate not recording the incident,that alone proves their negligence. Numerous emails have been sent to the insurer and to date i have not received a single phone call to discuss the outcome. I ham highly disappointed as i am employed by a broker and this is definetly not treating the client fairly. I find it more dissapointing that the fact that they drag their feet and keep making it my responsibility. This is definetly not the way to deal with a claim and keep shifting responsility!!!!!!!!
