Hollard Rejected My Vehicle Claim based on assumptions and prolonging the claim process

On the 18th December 2017, I was involved in an accident and my vehicle overturned. It was around 15:30 on a Monday.

No one was seriously injured, I then logged a claim immediately.

The car was towed at around 22:00 that same night to SMD Polokwane.

Now here’s the 1st problem, I always had to call in to get an update on my claim progress.

2nd problem is that after I was appointed an assistant, I was always promised feedback either in the afternoon or the following day. But unless I called, I’d never know the progress.

I then received a call in the 1st week of January that my car has been written off and that they’ve requested a Settlement Letter from Wesbank and should expect feedback in no time.

Eventually someone called me, named Nathan Kunene from a company called Legist Tracing and Investigators. He told me that he was appointed by Hollard to conduct the investigations. As part of the process I comp**** and gave him whatever he requested to perform his duties.

This is someone who gave me constant headaches. Never replies to emails on time or to return calls.

He told me he went and ask around and “ he was told: the car was speeding “, that’s number one.

Two, he jumped into an assumption that there’s no way a car can overturn in such a place unless one is speeding.

He furthermore told me that I should tell the “truth” or he’ll have to appoint an Accident Reconstruction Specialist “ which he apparently appointed eventually.

On the 24th January he called and told me the report is back and they both think I was speeding. I was told I’ll be receiving feedback from Hollard from there on.

At Hollard I was communicating with Walter Van Rensburg who also kept stalling until I requested his supervisor’s details by the name of Desmond Chinsamy.

He eventually called me on Friday the 26th to tell me that they’ve decided to “REJECT” my claim. I obviously asked why, then was told that based on calculations received I was traveling at a speed of 94 km/h on a 60 km/h zone.

My reaction was how was this achieved? 1, the reconstruction was done after 3 weeks, 2, people use that road everyday, 3, it has even rained, 4, there has been wind, so I’m still shocked.

Now he promised me that I’d get a call from Nkululeko Mayaba and a rejection letter on Monday the 29th January, which I obviously didn’t get, but I still wrote an email to Walter.

Today, Tuesday the 30th, I emailed again, but Nkululeko’s email is on auto reply.In my email I mentioned Hellopeter,that’s when someone by the name of Busisiwe Zulu called and explained what the next process is.

I called SMD for the release of my car and they told me that they are awaiting a release letter from Hollard.

Now because as much as I’m not happy with the outcome of the claim, I also don’t want to be responsible for the storage costs, I sent an email to Busisiwe who didn’t get back to me on time I then called Walter.

I interrogated him a lot on their decision. Now capture this(email sent to Hollard after my call):

Good day Walter

Yes I spoke to her and even wrote her an email after contacting SMD to collect the vehicle. They require a release confirmation letter from Hollard.

As discussed with you based on my unhappiness about the result of my claim, and as promised, I’ve got this on record: “According to Walter, the claim was rejected based on a calculation from the Accident Reconstruction Specialist, who did that apparently the second week of January, which I have a problem with. The accident was on the 18th and only after 3 weeks someone goes to the scene, really?

He did confirm though that the road isn’t in a good condition.

When I interrogated why was the Reconstruction not done within 24 hours after the accident? His response was that had that been done, the speed could have even been Higher than the current results calculated.

Therefore this clearly confirms my point that my claim has been rejected based on assumptions.

Why would the speed calculation differ? It should be the same regardless of when the reconstruction was done.

Even worse, how then does one trust a Reconstruction done after such a long time when the scene has been tampered with?”

Nevertheless, I’ll follow due process do that justice can prevail.

...when it slipped his tongue that the calculations are assumptions, he started getting angry telling me that I’ll need to speak to Busisiwe from claims.

They looked for loopholes, firstly rushed for hospital records hoping it was alcohol involved, then no proof o speeding as well.

Why did they debit my account even though they’ve decided to reject is a question I’m still not getting an answer on.

I’m so disappointed and dissatisfied??
