HOLLARD INSURANCE : WE ENCOURAGE HARDSHIP FOR OUR INSURED
I lodged a claim with Hollard Insurance for the damages to my vehicle as a result of the negligence of one of their Insured's drivers. Their Insured is a private company and the driver was at all material times during the accident executing his duties under his employment contract.
I contacted Hollard after two months of submitting my documents and was advised that the administrator Taliah Mohammed submitted my claim to the negotiator Mr Tumi Mokone, who failed to contact me and proceeded to close my claim prior to making contact with me.
Prior to my claim being re-opened I called the Third Party Liability/Recoveries Department for more than 3 consecutive days, which resulted in an acknowledgement and Mr Mokone providing me with excuses instead of solutions. During all our telecoms I requested Mr Mokone to advise me exactly what it is that he is doing, as he advised me during the first discussion that the security company could not release the footage.
I advised Mr Mokone that the security company will release the footage to the Insurers or SAPS, maybe even if a Request for Information in terms of PAIA advising why POPIA should be waived as the circumstances would permit the footage to be released. However, he insisted that the hurdle his facing is the footage. I am merely the Third Party but I need my vehicle to be repaired hence, I proceeded to contacted the security company who confirmed the email address and the circumstances that will permit them to release the footage, which is basically a direct request from the Insurer. However, Mr Mokone advised that he will proceed with the information on file, after he confirmed that his offices and the Insured could not obtain the footage.
It has been almost three weeks since I last received an update from Mr Mokone and I already submitted all my documents in January 2023. This is really not a difficult claim and I need an outcome to determine my next step.
I am not a client by Hollard and I will definitely not advise anyone to obtain insurance cover by Hollard. I am on the verge of proceeding with legal action against their Insure, which will mean that their Insured will be out of pocket when I obtain my judgment, which I will seek costs as well. I am confident about my merits , as I have footage which I intended to share with Mr Mokone however, he never responded to my request to send the footage via WeTransfer.
They say you will only know the worth of your Insurer when you have a claim, which can only be accepted or rejected. In in this instance I would personally say that Hollard is not very good at assessing claims, because a few months after submitting all the necessary information the claim has yet been finalized.

It seems that your claims department does not know how to proceed with advices provided and when ask to give evidence substantiating the allegations, the versions change.
How can a version from me reversing into your Insured change to both vehicles reversing at the same time? This is after I requested evidence in support of the allegation, as it was your Mr Tumi Mokone who advised that your client did not reverse into me and it was the other way around?
Furthermore, Mr Tumi Mokone said he holds a law degree and is an attorney, is this even true? As he does not know the basic principles of liability insurance, delictual claims or civil matters.
Kindly escalate this matter to the executive manager in the Recoveries and Liability Department.

I attempted to verify if Mr Mokone is indeed an attorney as he claimed he is on/or about the 14th of March 2023 and it seems that according to list of practitioners by the LPC he is not an attorney.
Furthermore, this confirms that Mr Mokone does not meet the requirements of being fit and proper as envisaged by the conduct prescribed by the FSCA/FAIS Act, as he has proven not be honest not does he have integrity.
I trust that this will be resolved soon.
