Read all the small print, before you get taken for a ride by this company!

In December 2011 I bought a new Juke from the afore mentioned dealership. As an extra I also purchased an extended service plan (5years/120000km) for R5422.75. With the understanding that the 5 years will start, after the 3 years factory plan expires! This is clear on the Invoice as well as on the policy documents ( incidentally with Autosure). The certificate of insurance states- 60 month service only policy at R 5422.75. It also says kms covered up to 120000km as well as policy initiation date of 16-12-2014! incidentally, it also mentions the 12.5% dealer commission which explains a lot of the actions of the seller Emily Borcherds, the branch F&I manager. All was well for the initial servicing until this year, which would have been the 4th service! All of a sudden, the insurance company refuses to authorise the service! They now say, it is only a 5 year service including the initial factory services!!! And they have the full support of the branch that sold me a 5 year extended service under false pretenses! I did check the "small print" of the policy, and on the last page (no pages where initialled by either myself or the seller! ) it states under the benefits schedule the following " your service plan entitles you to cover for 2 years or 60000km, whichever occurs first, limited to a maximum of 4 services." Which supports their views, but is totally contradictory to the front page of the contract as well as the Invoice made out by Nissan. And in my humble opinion, would not stand up in a court of law! Besides, who in his right mind would have paid that amount of money upfront in 2011 for 2 services? Definitely not me! Especially knowing, that the car would only do low mileage! The only plausible explanation is, that now that the costs of servicing are going to be more than the original amount paid they are not willing to honor the 5 years; or even worse, I was sold something under false pretences! Needless to say, that neither myself, nor hopefully anybody being made aware of this kind of practices and customer service will ever set foot into this dealership again! It is always regrettable when a client turns to a forum, such as this, to voice his displeasure about a perceived miscommunication SEVEN years after the date of purchase. The facts are that Group1’s F&I sold an Autosure policy to Mr Von Arx which clearly states that it is an extension of the factory service plan ( 3years/90 000km’s) to 5 years/120 000 km’s. The price of the Extended Service Plan was R5422.75 which attracted a 12.5% dealer commission. A whopping R677.84 as disclosed to the client. The fact that the FAIS and FICA rules are very strict about disclosure bears testament to the fact that the same F&I , Emily Borcherds is still with us seven years later.

It has nothing to do with reading the fine print and everything to do with remembering what you were sold, told and paid for seven years ago.

Dear Mr. St. Clair, You left me no choice, but to go this route, as even after getting Nissan SA involved you have not changed your perception! I do believe, the buying public has the right to know what Group1 Nissan Kuils River is all about! Unfortunately in my copy of the policy it does not state anywhere, that this is only a 2 year contract! On the contrary, it clearly states 60 months as from 2014, which is 3 years from purchase, and after the factory service plan has expired! To my knowledge 60 months are 5 years! Even your invoice says 5 years, without any other stipulations! So as I have said before, the wording of the contract is so vague, that it can be bent the way it suits one! However, the crux of the matter is; How can you even believe, it is "fair" business practice to sell a policy to a client that in 2011 cost more, than the services it apparently covered 4 and 5 years down the line! And this is a fact, supported by all documentation, of which you are in possession of copies! The whole point in taking out a service contract, is to pay a better price up front, which you obviously do not support! I gave you the opportunity to resolve this matter, but you only saw fit to reply once it had been made public in this forum! I do remember what I was sold, told and paid for 7 years ago, and it definitely was NOT what you are saying now! Many regards Andy von Arx
