GoBid Online Auction

On May 10, 2024, I travelled to Durban to collect the aforementioned truck. The initial inspection aligned with the damages disclosed on your website. However, I encountered several alarming issues not mentioned in the listing: 1. Start Capability Misrepresentation: The auction page clearly indicated that the vehicle was operational (“Asset Starts: Yes”). Contradictorily, the invoice I received post-purchase classified the truck as a “NON-STARTER”. This is a significant deviation from the advertised condition. 2. Undisclosed Structural Damage: Further examination revealed a bent chassis, a critical detail that was omitted from the auction photographs and description. This oversight has effectively reclassified the vehicle from a Code 2 to a Code 3, which is not what was agreed upon at the point of sale. I have documented evidence of the bent chassis, which I am prepared to furnish upon request. This discovery was immediately communicated to the auctioneers on-site, and I was advised to relay my concerns to you directly.

GoBid is refusing to rectify this Mistake.

We have reviewed our systems to get a data represented timeline of events and can report the following to you.  The vehicle in question was updated to reflect as a Non-starter on our website on 6 May 2024. According to the audit history on the vehicle on Timed Auction, you only started bidding for the vehicle on 8 May 2024. These records have been made available to you. Unfortunately this means that at the time of sale (bidding), the website did accurately reflect the correct starter / non-starter state before you started bidding. 
 With regards to the chassis being bent, this is the condition the vehicle was received in, displayed, photographed and made available for viewing. In terms of the CPA, buyer's have the right and should view any asset before bidding on any auction. Failure for you to view or verify the condition of the asset before bidding, is an error made by you and not GoBid.

In line with the Consumer Protection Act, we refer you to our GoBid Terms and Conditions. The acceptance of these T&C is forced before any buyer can bid on our website, and thus accepted by Mr Gibbons. 

GoBid will therefore not be refunding you in this case, as the burden of evidence shows that GoBid is not at fault.
