Housing Tribunal Panel: Unprofessional Attitude/Behaviour/Disrespect 1. Vuyi Mhlobo 2. K. Monyelele 3. E. Masombuka I had my Mediation on the 14/5/24. The respondent (Ithemba Property) was Absent. The Mediator issued me with the Certificate. Because the building manager/Security guard are Blocking my Exit/Entrance, I had to obtain an Urgent Spoliation. Firstly they never asked me to sign a register inside the boardroom for attendance. I signed the register at reception for being present. Secondly they Never had the speakers switched on when I was told to be seated. Thirdly one member asked me what the issues were. I asked what their names were and No response. The gentleman spoke off handed in a sarcastic high pitch of voice. I asked the chair person and the interpreter if the speakers were switched on. He said no, and she switched the speakers On. That's why I asked for the speakers to be switched on cause I can't allow any panel member to Disrespect me to speak in an Aggressive tone of voice. I stated that Zain arranged an Urgent meeting with the Panel member's for an Ex Parte Urgent Application for this morning. I was asked via email to be at the HT at 9am. That I have alot of issues unresolved with the Respondent (Ithemba Property). The gentlemen continued asking same questions regarding the biometric finger print Access. I explained that my finger prints doesn't register as i injured my fingers in a Vault door at the work place. That I issued management with an Afadavit that my finger prints doesn't register on Biometric Access. That the security guards and the Building manager Refuse me to Exit/Enter the building. That Zain arranged to Obtain an Urgent Spoliation for security guards/ build manager Not to block my Exit) Entrance. I don't know what arrangements were made but trust the process as Zain took initiative to arrange an Urgent Spoliation for yesterday morning. I tried explaining my situation regarding all ******** Acts Ithemba Property is doing and did. They didn't want me to explain my matter. How can I Not explain my matter? That's what the Tribunal Panel is therefore. Even though I had to Obtain an Ex Parte Urgent Application? I had to explain the other ******** Acts Ithemba Property is continuously doing. No maintenance done. All emails contacts Blocked. No Sanitation since March 2024. Adding their attorneys Legal fees to my rental statement ********ly. These are all Serious offenses and ******** according to the Unfair Practice Regulations 2001 Act. POPI Act. The chairperson stated that theirs No Return of Service in my file. I told him that I have personally issued Ithemba Property Portfolio manager (Hoddy Msibi) the HT Notice. That it's also same as return of service. He said that the case manager (Japhta) was supposed to send the Notice to them to obtain the return of service. How can the same document issued to me by the case manager Japhta be different. Japhta asked me to deliver the respondents notice and I obtained the Portfolio managers signature and the buildings stamp. This is a Legal HT document and should be valid as return of service. URGENT is not taken URGENT! I emailed my complaint to the Chief Director, Director and Senior for the case managers to intervene. I'm still awaiting a reply. Not obtaining the Urgent Spoliation is causing further Harassment/ Victimization/************ by the Respondent. What to complainants do in cases like these? Very Unhappy client 😌😌😌

I understand procedures should be followed, however confirmed with Zain that my matter for an Urgent Spoliation didn't need the return of Service done by the Case manager. As I have personally issued Ithemba Property senior management (Hoddy Msibi) the Notice and it should be Valid as the Return of Service.

PS: I feel that the Tribunal Panel Bul**** and Disrespected me cause I'm knowledgeable and know my rights. I asked them to Recuse themselves if they are disrespect and not allowing me to explain my case.They tried Patronizing my intelligence Expertise Knowledge and Wisdom. Using the Non Return of Service Not to issue me with the Urgent Spoliation and Not willing to listen to my Unbearable conditions I have to endure. I find them to be Very Unprofessional as Judge's Advocates sitting in their seats Patronizing clients and abusing their Power. Why do they became Tribunal Panel member's if they cannot give complainants the chance to explain the Unbearable conditions landlord/ Leasing Agents are putting tenants through. I asked the chair person what the date is for the postponement and ye said he doesn't know. They refused to give me their names. Postponing my matter for a reason that the case manager haven't followed the proper procedures to obtain the return of service.

NB: The chair person made up his mind Not to issue me with the Urgent Spoliation as I asked him to Recuse themselves in the beginning when the one Tribunal member spoke to me Off handedly and they Spoke Off record. Using the Excuse that Japhta (Case Manager) didn't follow the Correct procedures as an Excuse. This is Unacceptable and I have to Report their Unprofessional attitude and Behaviour to higher Management. I feel they Bul**** me. What do complainant's do in a case like this to obtain an URGENT SPOLIATION whereby the Tribunal Panel member's are using the Non Return Service as an Excuse. I emailed my Complaint to the Chief Director, Director and the Senior for the case Managers at HT. No reply. No Spoliation Order obtained, causing Further Harrassment/************/Victimization by Ithemba Property. How do complainant's obtain Justice. Landlords/Leasing Agents must bear the Consequences of their Il******** deeds. They playing with tenants lives. Having No Sanition is A Health Risk. A Clogged toilet for 3 months Actually Poses a Threat to your Health 😌😌😌
