My Opinion on the Contract Terms of FCSA

I entered into a 24-month digital contract with Fight Club SA ("FCSA") Clearwater branch in 2023, after downloading their app. The contract stipulated that a cancellation fee would apply in the event of early termination. I participated in 5 classes over a span of 1-2 months. The quality of the training was satisfactory, but I could not attend the gym classes regularly due to my schedule.

Two months into the contract, I requested to cancel it and discovered that the cancellation fee amounted to more than R5 000. This exceeded the total amount I had paid for the two months of gym classes. The management/owner of FCSA issued me a cancellation invoice and informed me that my debit orders would persist until the cancellation fee was settled.

I had only used the gym for 2 months of the 24-month contract. I understand that the 24-month rate is at a discount to the 6 month and month-to-month rates. I would have been willing to pay the full month to month fee for those 2 months and a reasonable cancellation fee for the administrative costs.

However, this was not the case. I was charged the 6-month fee of R1100 per month for 6 months, i.e., R6600, less any amount paid in terms of the 24-month contract. I paid approximately 8 times the monthly fee I agreed to, to exit the contract.

The cancellation terms of FCSA contract are unfair in my view.
