Incorrect Information, Credit Profile Issues, Poor Customer Service
I am extremely disappointed with Experian South Africa for ********ly listing prescribed debt as “payment information history” on my credit profile — despite the fact that this debt is no longer enforceable in terms of the Prescription Act and National Credit Act (NCA).
I lodged a formal dispute with Experian requesting the removal of this data, which is clearly not adverse nor lawful to list under the guise of “payment history.” They have refused to correct or remove it.
I escalated this matter to the National Credit Regulator (NCR), who issued a Notice of Non-Referral, and also to the Information Regulator, as this constitutes a breach of my right to privacy and data protection under POPIA.
I am now taking legal steps through:
The Magistrate’s Court
The National Consumer Tribunal (NCT)
A formal POPIA complaint
Experian’s ongoing refusal to correct this inaccurate and outdated data causes reputational damage, prevents financial opportunities, and demonstrates a total disregard for consumer rights.
🔴 I demand:
The immediate removal of prescribed debt from my credit profile
Written confirmation of compliance with the NCA and POPIA
A formal apology and damages for distress caused
If others are experiencing similar treatment from Experian, I encourage you to speak out and take legal action. This abuse must stop.
