EXPERIAN BREAKING THE LAW

Experian South Africa but Experian South African is openly contravening laws in South Africa which prejudices probably hundreds of thousands, if not millions of people. I have reported the issue to them on multiple occasions, so they are well aware of it, and they do not respond.

1. They do not engage with anyone unless they can ****** more personal information from the individual for their database. This is ******* and contravenes our POPI ACT (protection of personal information) and possibly other laws.

2. They publish adverse listings on people's credit profiles well beyond the legally prescribed timeframe. This is a contravention of the CPA (Consumer Protection Act). Once again, they are fully aware of it, yet they continue the practise whereby they knowingly and deliberately prejudice individuals and force them to engage in a process of ******ion of their personal information in order to request that an ******* and/or incorrect listing be removed. A dispute and authentication process can be followed for legitimate content, but the onus is not on the public to ensure that Experian does not break the law. They need to rectify these contraventions themselves, immediately. They need to have a system in place that when a listing reaches the legally prescribed expiration date, that the listing is automatically removed. Furthermore, if a creditor wants to list an expired debt, Experian should not entertain it at all.

3. The nature of their system enables them, whether deliberate or not, to list false or expired info on credit profiles, thereby damaging the individual, and ****** the individual’s personal information from them to have it removed. This practise is deliberately designed to populate Experian’s database through forceful ******ion of personal information. It's despicable.

This is not an issue of prescription of debt which is between a debtor and creditor. This is an issue of how long a listing can be reflected on your credit profile by the credit bureau. There are various timeframes for various listings but generally if the debt is older than 5 years it cannot be listed on your profile. Experian and possibly others are contravening several acts/laws in this regard. I encourage everyone to check this and take them to task. Perhaps a class action suit is in order as well regulars and ombud to discipline these guys.

Hi Experian

Thank you for the response, although it remains from a generic, uncontactable centre with no apparent human on the other end.
I don't know why you call it "Customer Relations Centre" if no relations are possible at all.
If you were serious about Customer Relations, you would send a reply that initiates conversation between humans where a matter could be discussed, understood and resolved asap.

I have sent you many emails regarding my complaints.
I would like you to remove any ******* listing from my profile.
I am not interested in you ******ing personal information from me before you will rectify your own contraventions.
Let me know when you have fixed it.
I'm not asking for disputes or investigations with third parties. I'm just asking you to fix your contraventions.
24 hours is all it should take.

I would encourage EVERYONE to investigate this issue and get you guys right.

I can confirm that staff at Experian either cannot understand English or have no intention to communicate. Simple questions cannot be answered or are deliberately ignored. It is impossible to have a conversation with a human at Experian that leads to any conclusion. If you ask them to do A, they will do B. It's like talking to a brick wall. The collapse of society and intellect these days is very scary to see. The companies that we traditionally hold in the highest regard have degenerated to the most pathetic and useless institutions. Banks, Experian, Cellular networks, etc, the biggest and most "tech" advanced companies are the most braindead, frustrating companies to communicate with. Forget about expertise! you can't even get sense out of these guys. God help us!

Experian have deliberately ignored simply questions and queries relating to their contraventions. the Ombud have confirmed that EXPERIAN ARE BREAKING THE LAW deliberately by continuing this practice, and even when challenged they persist. they seem to have some other agenda playing out here but it is not to be a law abiding company. I encourage EVERYONE to take them to task on this. Shut them down or bury them in admin and queries!!
