******** and *********!!!
I moved back with my parents before lockdown started in March. My lease contract managed by Etchells&Young terminates at the end of May. But Etchells and Young claims that they are only working remotely and cannot get the keys from me and told me that I am liable to pay rent until they operate physically again. I offered to mail/drop off the keys and told them to keep my deposit until their agents could work again (which is level 2 lockdown). And they refused. How is this lawful and ethical?

Right now nothing would make us happier than to be allowed back to work and earn an income again, including receiving your keys, doing the exit inspection and refunding your deposit. Regretfully we do not draft the laws or Disaster Management Regulations to be enforced during this crazy time of Coronavirus and COVID-19. Sadly it is in fact ******** for us to perform any Estate Agency Services at this time. You have decided that this makes us "******** and *********" and because of this and so have given us a One-Star review. We know you have since discovered that we actually are not allowed to be working, so come on, please remove this rather unfair and inaccurate review?

And here's my reasons why:
1. They claimed that I was liable to pay until they are allowed to collect the keys from me (lockdown stage 2); and refused my suggestions of contactless dropoff / posting / courier. They told me that it would be "impractical".
2. They also claimed that I would be liable to pay for the landlord's loss of income since they could not find a tenant at this time? (My lease was due to be terminated at the end of this month, why am I responsible for the fact that your agents might not find a new tenant?).
3. I already said that I don't mind getting my deposit when your agents are allowed to do inspection. So that was never the issue.
I am just wondering, how does the agent not working cause my lease agreement to extend?
All these claims from your agent are not legally valid. I am glad I got legal advise, I hope that no other tenants are being exploited like this, especially at times like these.

Even though we have given you several full explanations - you seem to be fixated on a few issues that are distracting you from the truth and from the crux of the issue at hand.
1. You are completely ignoring the fact that YOU HAVE ACTED ********LY and disregarded the Disaster Management Regulations, by going back to the apartment to move all of your stuff out. As there in NO CHANCE of finding a replacement tenant, the Landlord will suffer a financial loss as a direct result of your ******** ACTIONS (Ask your Lawyer and see the Delict issue below!) We said that we would ask our client, the Landlord for his further instruction with regards to if his legal options going forward...
You were also advised that it was ******** to collect keys and told that our office was currently closed. Your suggestion of creating a contactless drop-off zone is impractical and would entail either one or both parties acting ********ly to achieve this. We proposed that out Agent would contact you to collect the keys, once this could be legally done, why have you "forgotten" to mention this in your attempt to shame us and slander our good name?

Yes you may have given a correct notice to end your lease, no problem with that, but your ******** actions will result in a direct loss to the landlord. The morally right thing for us to do is to 1) Act in the best interest of our client the landlord and 2) Act within the Law.
