Can one select a lower rating than one star? A long read but worth it.

I had the very unfortunate privilege to deal with a vehicle purchase from EBK Auto Dealers Rosettenville, recently. The details of who, what and where is not important but, despite them having a news crew to advertise and broadcast their "good prices and interest rates" and the amount of vehicles they sell daily, live on air, just after I threatened to expose them, does raise some concerns. We were taken for the biggest, most dishonest and *****ulent rides of our lives. Not just us but the financial institution that approved the finance too. Let’s break down the facts all of which was only properly noticed after the sale was done, and the vehicle delivered, because the sales people are so in your face and talking as much as only a salesman can, for distraction: 2013 model vehicle, 133 000km, resprayed (looks like a dogs hind leg, re-painting done after sale went through), tears from the spray paint everywhere, roof and boot steel lining chiselled together at boot hinge, (have pictures as proof) roof looks like the vehicle turned over and the bumps was pushed out from the inside, no rear brakes, all door rubbers torn and not sealing, Handbrake not working, rear wheel bearings and brakes F*&cked (for lack of a better word), aircon not working, heater stays on, ABS sensor stays on (individual was told it will go off after a while of driving), steering shaking like hell at 30kmph, front right wheel grinding and sounds like it’s going to fall off at 70kmph, clutch shuddering at pull away, battery dead after two days of not running it, door locks worn out as hell, left front door not opening from outside, windows not opening and closing properly, roof leaking and roof lining covered in mold at drivers side, the list goes on and on. Yes, they told the individual who purchased it that they don’t recommend the car but it’s still an excellent buy at THAT price, and continued to sell her on it. First time buyer, no guidance, trusted the dealership, yet they financed it. The deal was loaded for finance with a reputable financial institution, approved on what EBK submitted as follows: R79 900.00 - Floor selling cash price (inclusive of VAT) yet they loaded VAT on finance again R10 000.00 -Repairs (for any repairs that needs to be done AFTER Dekra report) – ******* according to CPA R10 000.00 - Service and delivery (Serviced by Car Service City with a deal they have in place with them) R6 500.00 - Paint protection R13 750.00 - Mechanical maintenance plan (King Price) R3 000.00 license and registration (which still haven’t happened one month down the line) R123 150.00 total for finance, but wait there is more. After discussing the breakdown of the approved finance in detail with the financial institution who financed the deal (I got involved after the deal was done) it was found that a further R32 500.00 was loaded as "accessories" none of which was 1. requested, 2. explained or 3. received.

Total cost of finance with interest over 72 months and R20 000.00 deposit paid, R167 000 odd.

Shall I mention at an interest rate of 17%.......... because the individual is a first time buyer…..

No Dekra report, not even roadworthy, no known faults pointed out or itemized (as per Consumer Protection Act) nor acknowledged or signed for by the buyer, no mention of the 7 day return policy, 6 month breathing period for repairs as per CPA, nothing. Sign here, sign there and its done. We were VERY fortunate after submitting as much info as we can, details, report of happenings from day one and pictures of the condition of the vehicle, to have the deal cancelled and uplifted by the financial institution who financed it, in just two weeks so we can purchase a newer, better, much more reliable vehicle from a more reputable dealership.

Shall I mention that EBK also has no paperwork to sign to prove that the vehicle was delivered back to them. I stayed in contact with them on our way to them, saying we are returning the vehicle and took pictures and a videos as they got into the vehicle and drove it back into their Yard, Cover yourself!!!!!!!!!!! I am not going to name names, nor break down the dealership, I am stating and will purely state facts. I urge anyone who buys from or is thinking about buying from EBK Auto Dealers Rosettenville, , to ask for a OTP – Offer To Purchase (which was never seen as all is done electronically and they even facilitated Insurance through King Price) to see what exactly, line by line, they submit to any Bank for finance, read every line, understand every cent you are financing with ANY financial institution, make sure EBK's TAX invoice reflects what you apply for and not just the vehicle and delivery fee as in this case. Question every line item that you will be paying dearly for, for the next 5/6 years, before signing ANYTHING. Its your RIGHT.

People, know your rights when purchasing a second hand vehicle and insist on them. Herewith a link to very important information when purchasing a second hand vehicle from ANY dealership. Do yourself a favor, read it, watch the video and know your rights. The CPA was brought into effect to do exactly this, protecting the rights of consumers. https://bblaw.co.za/2023/05/31/second-hand-vehicles-and-the-cpa/

Dont fall for their illiterate sales people telling you they are the fastest growing dealership in South Africa and them showing you and old Toyota building they purchased and they are expanding, its all to make you feel "comfortable" with them. DON'T, be weary at ALL TIMES.

I furthermore urge all banks, financial institutions and insurance companies, for the sake of your reputation, that finances or covers vehicles with this dealership, to properly investigate and understand what they are actually financing. Insist on a Platinum Dekra report, diagnostic report and anything else that you may need to make an educated decision on allowing finance for ANY amount of money with this dealership, in the interest of your client, the buyer, as this will fall back on you as you effectively purchased the vehicle and the purchaser “leases” the vehicle from you, over a period of 5/6 years till paid off. Everyone should also note, and not a lot of people know this, understand that your fight should not ever be with the dealership if it comes to this, but rather with the financial institution that granted the finance as it is ultimately their vehicle once they paid the dealership. KNOW YOUR RIGHTS
