Excessive billing for ZERO administration

Last year I complained about how your company bills me. You Bill me for the smses you send. You Bill ME if I call YOU. You Bill me for emails. You Bill me for any type of contact when you fail to update me on the state of the ***.

This morning I recieved a second batch of SMSes to "remind" me of payment, when you already sent texts the day before. So you get to Bill me DOUBLE? This payment was made yesterday, as an immediate payment. So I expect you to remove the bill for these unnecessary communications.

Further to that, in the time you have had my ***, you have only ever sent me a full statement after my request, WHICH YOU ALSO BILL FOR. Otherwise you simply send a short total summary (also ONLY at my request) which you conveniently also bill for.

This is unacceptable. I have a right to know where the *** stands, and a monthly statement should be bare minimum within the service you provide considering you also bill me 11 percent on any amount made.

In addition to that, you refuse to meet me halfway with a settlement discount, which I find extremely odd since I have previously had a discount offered to me on the same ***.

I demand a monthly statement, free of charge due to the fact that the previous statement proved to me you Bill individuals as you please. I would like to settle this *** so please contact me regarding a settlement discount.

It is utterly disgusting that I cannot communicate with you in any format be it at my own cost or not, without you charging me for it.

And yet... To date - you still have not sent me an account statement as requested in this complaint. Is that also in accordance with the law?

Since you quoted the law to me rather than resolving the statement issue, the public should be aware that this company refuses to send me regular statements of account unless I explicitly request them, and then bills me. To make matters worse, whenever I do request an update on my balance, they actually bill me an administrative fee just to see what I owe. They also bill me to contact them... TO REQUEST IT This is a direct violation of South African law. In terms of Regulation 11, read with Item 5 of Annexure B of the Regulations under the Debt Collectors Act 114 of 1998, a debtor is legally entitled to a free statement of account every six months. A debt collector is only allowed to charge a fee if an additional statement is requested within that six-month window. Because Easton Berry does not routinely provide statements, my requests fall strictly within my statutory right to receive a free bi-annual update. Furthermore, under Section 19 of the Act, a collector cannot recover any amount from a debtor other than the capital debt, lawful interest, and strictly prescribed legal fees. I demand that management contacts me immediately IN WRITING to *** to: 1. Reverse every single statement fee or administrative charge unfairly added to my balance after this complaint has been addressed. 2. Provide me with a comprehensive, accurate breakdown of my account (reflecting original capital, payments made, interest, and legal costs) at zero cost. If this is not resolved swiftly and the ******* fees are not removed, I will log a formal complaint under oath with the Council for Debt Collectors to investigate your billing practices.

Good day,

Thank you for bringing your concerns to our attention.

We have reviewed the matter and wish to clarify that the account is administered in accordance with the applicable legislation governing debt collection and is therefore subject to the prescribed fees and charges.

Following a review of the account activity, we can confirm that certain communication charges raised in your complaint were not applied to the account. In addition, and as a gesture of goodwill, a portion of the communication-related fees has been reversed.

We further wish to advise that statements are not issued automatically. However, debtors are entitled to request a statement free of charge once every six months, and additional statements may be requested through the appropriate communication channels.

We acknowledge your intention to settle the account and appreciate your willingness to resolve the matter. While there is currently no settlement discount available, our team remains available to discuss settlement of the outstanding balance.

As this is a public platform, we are unable to discuss specific account details. We encourage you to respond to our email should you have any outstanding queries or require any further assistance, and we will be happy to assist.

Kind regards,

Maheshree
