False Advertising

My fiance and I took up a contract with DVC on 14th February 2016.

We were sold a membership for 2000 points to the value of R38000 plus an annual membership fee of R4400 by Mr D. Chetty. We paid a deposit of R3800 on the 14 Feb. We were informed by Mr Chetty on more than one occasion that the R4400 owing could be paid in a lump sum no later than December of the same year.

On the 1st of April a debit order of R440 for annual membership was deducted from my fiances account, he requested my bank to reverse the payment as he was prepared to pay this monies at the end of the year

He then informed DVC of the deduction and subsequent reversal.

He was then told he would be in arrears until the R4400 is paid and that he wont be allowed to use his points until such time that the account is paid in full. According to staff at DVC the allowance to have the subs paid in December is only open to clients from year 2 of membership.

This was not made clear to us at the time of purchasing the membership and it was one of the deciding factors in taking the offer.

This is when we decided to cancel the membership. He received an e-mail stating that he will be refunded in 21 days.

A few days later we received another e-mail stating that the issue has been resolved, we will be allowed to pay the annual subs in December and will be allowed to use my points. We accepted this offer but unfortunately when we tried to make a booking he was told the account is in arrears. To me, and I might be wrong, but selling a product without informing the client of all the details sounds like false advertising.

So now we request them to continue with cancelling the contract as we are not happy with the service we are receiving and all the false advertising. We are now being told that we cannot cancel and are being threatened that we will be blacklisted. This is so disappointing as we have not even used this contract, we have been trying to cancel since mid April. Has anyone had any joy in resolving this kind of issue with DVC. All we want is a refund of our deposit.
