Dream dress disaster

After consulting with Gert on 24 July to have a specific dress made for my daughter, I paid the quoted R5480. On 8 August he fitted and pinned a lining for the dress. First fitting on 12 Sept. The dress was put on in front of a mirror. After about 2 minutes, Gert asked whether she was satisfied. He then left the room and my daughter communicated her disappointment to me. Since it was so close to the dance date, we did not have any choice but to take the dress and sign for it.
At home, we discovered the following:
The dress looked cheap, was way too small and the materials used was not as specified. After 15 minutes in the dress, she complained about sore breasts, itching arms and difficult breathing. She also couldn't lift her arms or strech forward. Gert never tested his dress for wearability.
After getting a professional opinion locally, I returned the dress to Gert on 18 Oct with full explanation as to why. I requested my money back but he bluntly refused saying that I signed for it. Gert proposed alterations to make the dress bigger but I declined fearing a worse disgrace and I left without the dress. Communication afterward was answered with a very ****y attitude.

Hello Pandora101,

1. The selection of the fabric was confirmed with an sms from your daughter. 2. Lace @ R950/m & silk chiffon @ R150/m cannot look cheap. 3. I left the fitting room to give your daughter privacy to get dressed. 4.You stayed & chatted another 10 min before signing the acceptance form & left. No indication of unhappiness. 5. You returned the dress without your daughter - I could not fit the dress to confirm your complaints. I offered to do any alterations you want. You refused. 6. In a mail sent on 22/9 I again offered to do alterations - you did not respond. 7. You phoned on 28/9 & requested a refund. I again offered to do any alterations to your satisfaction. You refused & I refused to refund. 8. You got your local opinion from your neighbour - I had 2 other designers look at the dress, both agree it's a 1st class article. In closing: You refused to produce your daughter & prove the 'faults' on the dress. By doing so you purposely prevented me from resolving this issue to our mutual satisfaction, trying to force me to do a refund. This is a clear case of buyer's remorse, being passed off as something else. Regrettably, I cannot refund for a product that is not flawed.
