Car accident claim not paid out - worse their driver's licence expired 2 years ago
my car was involved in an accident with one of the staff members of lewisgroup (Graham Modern) and only to find that when we got to the police station that his licence expired 2 years ago and which was captured down on the statement which was submitted to his company by him and his company forward the matter to their Insurance which is DIGICALL claims administration solution and got us in contact with the manager Herman Theunissen who was in communication with us at the beginning however stated giving us the run around that they will not pay the full claim even though it was their drivers fault who drove into our car and i refused to accept it as if it wasn't for him bumping in to us then we wouldn't be in this mess financially and i kept following up with Herman and he then came back with the 2nd offer not still not will to pay out the full amount and i refused to accept it as i do not have the remainder of the balance to fix this car and it was not in my plan nor budget. now i sent couple of communication to Karen and Herman and they just read my emails and not respond at all.

After an investigation into your complaint was completed we received feedback as follows:
This was a Third party approach against our client Lewis Stores. After an assessment of the merits it was found that our client acted in sudden emergency and the Third Party had no supporting independent eyewitnesses to support their version of the accident. Thus in good faith an offer was made of 50% of the Third Party’s damages which was not accepted. We then revisited the matter and amended our offer to a full and final offer of 70% of their damages and informed the Third Party that if not accepted they can then further refer the matter for litigate and we will proceed to call for the same settlement in a ruling by the courts. In addition we will then also call for wasted costs.
As for the driver’s license, we had received from our client’s driver a valid driver’s license that shows his license was issued in 2005. Whether he had a valid card license on scene or not, we cannot comment on. However the proof received shows that client did obtain a license in 2005. Although his driver’s licence card may have expired, his driver’s licence itself is still valid.
At no time was there delays in the processing of the claim as proper process and procedure needed to be adhered to.
We believe the offer to be fair and just and we stand by our decision.
