Defy selling flawed appliances at premium prices

Hi

I purchased a Defy microwave from Game Store Galleria Mall, less than a year ago. Last week while my wife was cleaning the microwave, she noticed that a part of the microwave was starting to catch rust. She notified Game Store Galleria Mall about the rust on the microwave. They reply, was that warranty doesn’t cover rust , they cannot help us and we can to buy a new microwave if we want, that’s what Defy told them to tell the customers .I think this is unfair to customers in general, as it has been less than a year and the appliance is rusting. Defy is selling flawed appliances at premium prices and do not want to take responsibility for their flawed appliances. I want Defy to sort out my microwave, if I do not receive a response , I will be posting this matter on social media, also I will be seeking legal advise from my lawyer.

Good day Keegan,
We apologise for your inconvenience.

We take great pride in manufacturing high-quality appliances designed to deliver long-term performance and reliability. However, when it comes to rust, there are numerous external factors—such as environmental conditions as living in a coastal area, cleaning methods, and exposure to moisture. As a result, rust is not covered under our warranty terms and conditions that you can find on the website.

We understand your frustration and are here to assist with care and maintenance guidelines to help protect your appliance and prevent further concerns.

Warm regards,
Defy Customer Care

I understand if the microwave was about 5 or 6 years old,not couple monthly. Is the microwave made out of tin by any chance. I want my microwave replaced or I will be taking legal action,as you can not sell a product in South Africa that rust in couple months regardless the conditions.

Good day Keegan,
As previously advised, rust is considered a result of several external factors and is therefore not covered under warranty, which unfortunately means it does not qualify for replacement.
Warm regards,

This matter will be handed over to the ombudsman, as you can see you are clearly a cheap rogue.

In South Africa, the Consumer Protection Act (CPA) provides a six-month warranty on goods, including appliances, for defects, including rust, that make them unfit for their intended purpose. This warranty means that if an appliance develops rust within six months of purchase, the consumer can return it to the supplier for a repair, replacement, or refund. The supplier is responsible for addressing these issues, even if the fault is covered by a manufacturer's warranty

Good day Keegan,
We are aware of CPA and your right as a consumer. Retailers are also aware of this and will advise if your microwave qualifies for CPA.

Please visit your retailer.

Warm regards,

I'm trying to solve this matter without getting my lawyer involve, but you are refusing to do so .If your company has to pay a hefty law suit, they can thank you for that.

Good day Keegan,
We remain committed to working toward a resolution within the framework of our company policies and service terms. CPA has also been acknowledged and will be considered by the retail team if applicable.
If you still feel legal action is necessary, we respect your right to proceed accordingly.

Should you wish to continue discussing the matter constructively- please visit your retailer as advised.
