Good Day

Kindly note that I was assisting you with your complaint and have received a response from Debt Works where they have attached telephone recordings of the conversations you had with their consultants.

One conversation that I have been trying to discuss with my legal advisor is one that you had with Kim while she was busy explaining how the process will work, and where she asked for your authority to perform certain actions.

It appears that they declared you to be over-indebted with the information obtained from you over the phone. This means that they then sent this notice to the credit bureaus and to all your creditors informing them that you are now under debt review. Although you informed them that you wanted to cancel, they had already put that information against your name.

Another challenge that we have is that, with the new debt review withdrawal guidelines that came into effect on 19 February 2015, that state that once a consumer is declared over-indebted, they cannot exit debt review until they're done paying their accounts.

I will discuss this further with our legal advisors and find out what can be done.
Best regards,
