Pay for my car damages caused by your driver

Good Day Sir/Madam I am herewith writing to you again about the Car Accident that happened on Sunday the 29th November 2020 between the Debonairs (Maponya/Dube) Motorcycle with registration DR13LH-GP driven by Yusuf John a Debonairs employee, who at the time of the accident had no drivers licence on, but later that night produced a drivers licence from Malawi. On the evening of the accident the driver conceded that he was wrong, immediately after the accident the driver pleaded that we let him go and report the accident as a hit and run. Secondly his manager advised him to pay me R10 000.00 so that if I have insurance I can claim with them and let Yusuf go. I did not agree to all this, we went to the police station after having waited for more than 2 hours for the Police/ JMPD to come to the accident scence and an accident report was filed at the Orlando SAPS. SAP176:109/11/2020. OB:3632/11/2020. On Monday the 30th the “owner” by the name of Terrence was alerted of the accident after Yusuf and his managers tried to hide the matter from him bombarding me with calls trying to buy me out of the accident. I called Terrence after asking for his numbers constantly from Yusuf. He was shocked to say the least when he learnt of what had happened. On Tuesday the 1st of December 2020 at 6pm we met with Terrence, Ndalamo and Yusuf at Maponya Steers, upstairs. We met there and Yusuf admitted that he was a cause of the accident and that he admits that he damaged my car whilst on duty with the company motorcycle. We left the meeting clear that they will claim from the company insurance and revert back with feedback. Terrence promised that this will be resolved and that after this whole process they will even offer a token to say Thank you for my understanding during this process. On the 2nd December, Wednesday morning I sent Ndalamo the manager all my particulars for and the accident OB and he said “we will let you know if we need anything further”. The week went right on until I asked for feedback on Friday the 04th December 2020, Ndalamo called and asked for a second meeting to be on the 5th December 2020 at the same spot as the first. Terrence leading the meeting told me that the insurance has concerns about the damages of the car because they do not make sense, that how can a mere bike cause to much damage. I asked them to provide proof of the claim and they could not. Instead Terrence kept manipulating Yusuf to deny having being the cause of the accident even when he constantly and repeatedly say he crash into my car. I had brought in the car so that Terrence can see the damage caused since he was sent by the insurance to do investigations (I did not know that your Franchise owners are qualified insurance investigators). I am done talking to Terrence and his employees and ask that you attend to this matter as soon as possible. I cannot be paying the Bank for a car that has been damaged and in a bad state, because Debonairs, Franchise owners do not have insurance. Please attend to this now with utmost urgency.

Kind Regards Naphtalie Lindokuhle Msibi
