Unfair default

I am writing to express my disappointment and frustration with the way my account has been handled.

I signed up with Credit Salvage for credit clearance services as a returning customer, after previously using your services and referring several clients to your consultant, Sindile. However, after one failed debit order due to unavailable funds, my account was immediately placed under default without fair consideration or proper service delivery.

After being contacted regarding the failed payment, I informed your team that my payments were delayed and proposed to make a deposit instead. This was refused, and I was told it was not allowed. I find this extremely unfair, especially considering that no actual credit clearance services had yet been carried out on my account.

It is unacceptable to place a customer under default when no service has been rendered. As customers, we should only be expected to pay for services that have actually been provided.

Furthermore, many of the people I referred to your company have experienced similar issues: multiple follow-ups, ongoing deductions, and very slow or non-existent service delivery.

I trusted Credit Salvage based on my previous experience, but this has left me highly disappointed. I would like a clear explanation for the default listing and immediate rectification of this matter.

Thank you for your message. We have investigated and want to address each concern directly and clearly.

1. Regarding the failed debit order
Your first debit order returned unpaid. In terms of the signed service agreement, when the first instalment of the agreed contract terms fails and no immediate cash payment is made, the file is automatically placed into default and paused until payment is received. This rule applies to every client to ensure fairness and consistency. We work very quickly for our clients as you experienced the first time you joined us and if you chose a monthly repayment installment it is vital that the first installment gets honored. 

2. Efforts made to assist you before cancellation
Our records show:
  • You were contacted immediately after the failed debit order
  • You were given multiple opportunities and extended time to make a manual payment
  • Despite these extensions, no payment was made
  • Several follow-up messages were sent, all of which went unanswered
Because no instalment was received, we were unable to proceed with any credit clearance work. We cannot start a clearance matter without the first instalment being settled, as it covers compliance checks, 5 bureau report investigations, creditor contacts etc and the dispute preparation process.
3. Compliance with the National Credit Act
In line with the Act, we issued a formal demand notice via email, post and sms when the account remained unpaid. You were given the full 20-business-day period to settle the cancellation fee. No response or payment was received, and the cancellation was processed strictly according to legal requirements.
4. On your comment that “no service was rendered”
The file did not proceed because the required first instalment was never paid. We cannot launch disputes, contact bureaus, or request records without the account being financially activated through the first instalment. The on hold was therefore not due to lack of service it was because the account was never financially activated due to your failed debit order and no cash payment.
5. Regarding your referrals
We cannot comment on any individual client of yours due to POPIA, but we can confirm the following:
  • We have no formal complaints from any people you referred
  • One of your referrals is currently preparing a 5-star review after we successfully obtained a court order to remove his debt review indicator
  • No negative service issues have been reported back to us through any of the proper channels

6. Final position
Your account was handled strictly in line with our contract terms and the National Credit Act. We made multiple attempts to assist you before any cancellation steps were taken. Unfortunately, without the first instalment being paid, we were unable to proceed with your clearance matter.
