After 7 months of waiting for Cosmo to replenish my Garden they have resorted to not taking my calls!
From August 2020 I have been in battles with Cosmopolitan Projects agent Mathys who wanted to ambush me into agreeing that they have a right to remove my outside yard garden and they are not liable for any restoration or compensation thereafter as our garden was in the way of them accessing water pipes for a new development site near our house. Unfortunately for him I followed on with the issue right through to a point of involving the counsel in the matter and my rights in this matter were re assured!
After 3 months of the garden being removed I followed up with Cosmo team and kept on getting one excuse after another for the delays of replenishing my garden, it was only in January 2021 when they paid for a land scaper to come and build the new design structure of the garden. It took me yet another 2 months to constantly following up on grass, plants, gabion rocks and refunds to be processed and I only got grass delivered in April! We are steadily approaching the mid month of May and guess what? The agents who have been involved in this matter have went from giving more and more excuses for the delays to not answering my calls!
I am very grateful for the fact that I ensured that our agreement is in writing and that Mathys acknowledged it, I am beyond disappointed with Cosmopolitan Projects, be alert when getting into any discussion/agreements with them as they are not big on honoring these...

I have taken up your post with Mathys this morning.
I was aware of the history of your frustration.
Per your post Mathys confirms all is correct as you have stated.
There was a settlement agreement which was done as a good faith gesture to you. We did not enter an agreement due to any legal requirement or non-performance on our part. We did an agreement with you to ensure you are satisfied with your new home.
The intial garden which you had created was not on your land but on the public pavement, of which services needed to be laid for further houses in your area. Unfortunately the garden had to be removed for services needed.
Per the agreement there were several items we undertook to restore the garden area. All of the items agreed to have been implemented except for this last stage you mention. The last attended item (wall) being completed last week.
On this last matter you are aware that we still wait appoval from Land Development before we can proceed.
Once this is available to us, Mathys will make contact with you.

To provide clarity; the garden in question is a garden that is outside my house in a space that is regarded as that of the Municipality (NOT Cosmopolitan), prior to investing on making a garden outside OUR yard the Municipality was consulted and we were advised that as a homeowner one is allowed to alter a garden however having permanent structures is highly discouraged as the Municipality might need to access the utilized space in future. Cosmopolitan's construction company has been granted authority to proceed with construction next to my house HOWEVER that does not include destroying anything that is in "their" way. In this matter; as a resident in the municipal space I cannot refuse for Cosmopolitan to remove my garden HOWEVER Cosmopolitan is responsible for putting me back in the same position that I was prior to the removal of my garden or better hence Mathys could not obtain a court order he wanted and claimed he will obtain for forceful removal of my garden, on our mails of engagements I stated clearly that I am not refusing for the garden to be removed however what I wanted acknowledged was the responsibility on your side that came with such removals (not that he ddnt know of by the way)
