CelluCity do not honor their warranty

I was sold a dud Iphone 8 with pre-existing software issues but when I returned the phone a day later they refused to honor the Out Of Box fault as it had a tiny scratch on it which I definitely did not cause... How can they not honor thire warranty due to a scratch that has nothing to do with the Software malfunction on the phone?
