UNFAIR DISHONEST BUSINESS PRACTICE

In May 2016 I app**** for CELL C WIFI bundle for R299 20 GB- 10 nite- 10 day. My first application was declined and when I queried it I was advised to send 3 months bank and payslips where-after on 6 June 2016 I received a call confirming it has been approved.

At the time of the application, one of my questions was if I will be able to top-up and the consultant said "no" and that I will have to wait for the new month if my data runs out.

I recently noticed a deduction of R1000.00+ from my bank account by Cell C and when I called the consultant told me it's an open-line and I would have to call 084140 to put a limit on it. When I called

the again ON 03/08/2016 to complain the consultant advised me I will get a call from migration dept as well as complaints dept. As to date, I have not received a call from complaints dept and the migration consultant that called said I will have to pay fro migration and I will not be getting the same same package for R299 but

for R499 as it was on special when it was approved.

I have advised them they need to listen to the recordings since my application in May and they will notice that no one told me this is an open-line, how can I be made to pay for something that I didn't apply for.

As a consumer I have the right to right to fair and honest dealing, the disclosure of information and the right to just and reasonable terms and condition as well as the right to accountability by suppliers and fair and responsible marketing. If you listen to the final call with the consultant, before I ended the call, just to make sure I asked if it's R299 and he said yes.

Was that just to get the sale? Why was I told I will not be bale to top-up if the package is avail for top-up and why was I not told that this is an open-line?

Now firstly- I questioned both consultants on the top-up possibility, and I was advised I cant. They also explained why I didn't qualify for the package when I first app**** and I was explained thoroughly.

Secondly, whenever I app**** for a line at Cell C, the terms top-up and open line was used and not post-paid and hybrid, and he wanted to tell me the terms top-up and open line is never used.

When Matshidiso called me back to advice me that my application was declined and offered me a lower package which included a cellphone I declined and that was the end of the discussion until I called back a couple of days later to get more details on why I was declined and the
consultant who assisted me was Davis Mabuso.

I also quote Patrick as saying "the call that form part of the contract is the person who got you the deal-good delivered to you" and that person he only referred to as "our guy".

The "guy" Patrick refers to is actually the person who got me the deal and his name is Davis Mabuto and he is a direct sales agent, and I dealt with him until the morning of the

Why did Patrick refuse to mention Davis's name and only referred to him as "our guy" ? I understand that Cell C or employees might not want to accept liablility in the this matter which is very unfair.

I had policies that reversed after that deduction was made on my bank account and it will probably happen again this month, while I made it very clear to Davis that I can only afford R300.00.

I should've been given the option to choose whether I want an open-line or top-up as this deal is available in top-up.

I'm very dissapointed in CELL C and I have have to rethink if I even want to upgrade one of my lines that that is due for an upgrade in the next few weeks.
