Terrible Service and Breach of Contract by Cell C
I have been a loyal customer of Cell C for over a decade, but this recent experience has been nothing short of appalling. Despite my repeated requests for proof of a price increase notification, Cell C has failed to provide the required documentation or a specific date-stamped proof of notification. According to their contract terms, they are obligated to notify me at least 20 working days in advance of any price changes. This hasn’t happened.
Their response? A vague claim that an SMS was sent in November 2023, without any specific date or proof to back it up. This lack of transparency and accountability is not only unprofessional but a direct violation of their own contract terms and the Consumer Protection Act.
To make matters worse, they outright refuse to process my contract cancellation without penalties, despite their breach of contract. After over 10 years of loyalty, this is the service I receive. Absolutely disgraceful.
I will be escalating this matter to the National Consumer Commission and ICASA. Cell C, you have failed to honor your contractual obligations, and this breach of trust will not go unnoticed.
If you're considering Cell C, think twice. They don't seem to care about keeping their end of the deal or providing proper customer service.
I have previously made it clear that I prefer all correspondence to be conducted via email. Additionally, I have specifically requested to be contacted by senior management regarding the cancellation of my contract.
My Position Remains Unchanged:
Failure to Provide Date-Stamped Proof: The SMS notification you refer to has not been substantiated with verifiable, date-stamped proof, which I am entitled to receive. I cannot accept your response without such documentation.
Right to Cancel Without Fees: Due to the breach of contract and Cell C’s failure to meet its obligations, I am entitled to cancel the contract without incurring any penalties, and I expect this to be honored.
Next Steps:
If this matter is not satisfactorily resolved and escalated within 5 working days, I will proceed with my previously mentioned actions, including escalation to the National Consumer Commission (NCC) and ICASA, as well as considering further legal options, such as filing a claim with the Small Claims Court. I also reserve the right to pursue legal recourse through my lawyer if necessary.
I look forward to a prompt response from senior management confirming the cancellation of my contract without any fees or penalties.
