Shocking events - seeking legal advice
<p>My wife and i went into Cell C in the Pavillion Shopping Centre and noticed that they had some fantastic deals for November 2016. We spoke to a Consultant by the name of Thami - who's only flaw in this entire saga was that he did not keep in contact with us frequently enough and provide updates as the situation changed. We looked at the Huawei P9 Lite and decided in one of the more expensive contract options so we could qualify for the R3000 cash back deal (at R349 p/month over 24 months). It seemed a win-win. Thami got a phone, we signed contracts and he bundled the phone, contract and cash back voucher together until my wife's number could be ported from Telkom Mobile.</p> <p> </p> <p>Herein started the trouble.</p> <p> </p> <p>The porting failed. Allegedly because the banking details i provided were different to those i use for Telkom - which is nonsense as i have one account and the banking details provided were on a print out of my bank statement.</p> <p> </p> <p>Thami apparently tried to call once over a weekend to inform us. </p> <p> </p> <p>We went in to check and were told Thami was off. Also three staff members were bust for ***** - so everyone was running around like headless chickens. We got no joy.</p> <p> </p> <p>We tried calling numerous times. Phone is engaged most times. My wife eventually gets through and is told some distorted message that the porting failed and they have no stock of the phone anymore!</p> <p>We go into the store again. This time Thami is there and he tells me the news about the porting failing and that he tried calling (once - apparently). So i suggest we try porting again but to prepaid and then we swap to contract after - so he puts it through like that. No problem.</p> <p>So we're told once the porting is done and a message comes through confirming and my wife's sim is on Cell C then we must come in again. </p> <p>We go in again and this time Thami tells me one of the other Consultants took the phone he had kept aside for me after the porting failed!! And now they have no stock!! So now we have to leave and wait until the stock arrives - and he'd call when it does.</p> <p> </p> <p>Thami calls - late - and lets us know stock has arrived. We go in. Happy to be signing up - BUT WAIT there's a snag - since the porting failed the first time we're now told we cannot get the initial deal we signed for as this promotion was for November and we're under the December deals at R100 more per month!!!!!! </p> <p> </p> <p>Shocked and dejected we left to weigh up competitors options.</p> <p> </p> <p>The failure of the initial porting wasn't our fault and we lost out on a deal we signed for - because of Cell C and their complete uselessness.</p> <p> </p> <p>I'm getting my wife signed up with MTN now. I didn't want her to have the same network incase we're stuck in the sticks somewhere. But anyway.</p> <p> </p> <p>I've got close friends that are in the legal profession. I've approached them now to discuss this case and see if i have any claim against Cell C for breach of contract.</p> <p> </p> <p>Let this be warning - don't go near Cell C.</p> <p> </p> <p>Oh and while we were there all those times - LOTS of people came in to complain about being debited twice - and Cell C gave them all - including a lady that works in public service (Fire Department) - the run around.</p> <p> </p> <p>B.Hoffmann</p> <p> </p> <p> </p>
