Retracting on legally agreed contract
<p>Cell C repeatedly called me on the 12th and 13th May to try and discuss upgrade options/contract options.</p> <p>On speaking to the agent I was offered a Samsung Galaxy J5 – I asked the agent to speak to a colleague of mine who confirmed that it was a good deal.</p> <p>On the Friday (13th May) I agreed telephonically to the deal being offered which was: a Samsung Galaxy J5 with 100 minutes/100 SMS/100Mb data and 1Gb Whatsapp data for R259.00 per month.</p> <p>An agent then called me back later (on the 13th May) to notify me that the deal was no longer available and I would only be able to get it at R279.00 a month + R7 for Whatsapp data a month.</p> <p>I refused to accept these new terms as this is not what I had been offered or what I had accepted and agreed to – the original offer legally was what Cell C and I had entered into a telephonic contract on.</p> <p>Around the 18th May I AGAIN received a call from a Cell C agent (I think her name was Sue) to offer me the same phone with 100 minutes/100 SMS/100mb of data for R259, but I would have to pay R7 for the Whatsapp data. This agent even read me the terms and conditions of which I agreed to, and notified me that my phone would be with me within the next 2 – 10 working days.</p> <p>Not having heard anything after this, I followed up with your contact centre only to be told that they “had no record” of this deal – on disputing this the woman called me back and told me the deal was no longer available and they could not offer it to me (this was Friday aafternoon about a week or 2 ago).<br /> I requested a supervisor or manager call me back and was told someone would call back the same afternoon – to date I am still waiting.</p> <p>NOTE: a formal complaint has now been raised with the NCC against Cell C as they have not responded after numerous requests to rectify this issue. This was a legally binding contract that Cell C retracted on.</p>

Interesting - you responded very quickly to this complaint but have now gone extremely quiet again? Someone called me and said that they had to find the recordings. There are apparently outside vendors and they had to get hold of them to get the recordings.
The woman called me back the next day and said they hadn’t managed to locate them but she was going to continue trying to locate them.
She said that she didn’t doubt me because I wouldn’t have known about the deal if I hadn’t been called about it. But then she never called me back.
As the people who had called me about the deal also spoke to my colleague to discuss the deal on my behalf (as I needed him to verify the details for me) I have someone who can verify from my side that these offers were in fact made.
I expect a call from Cell C within the next 24 hours to formally apologise and to rectify this mess they have made, as I am due an upgrade and want this deal as it was offered to me - it either needs to be as per the offer that I accepted over the phone, or something of the same standard/price or better (as is my right as a consumer).

aaaaand....still promises are made and the silence continues. Why lie to us that you are going to contact us? It has now been over a week since you last claimed someone would be in contact and not 1 communication in any form has been received.
I expect someone to contact us within the next 12 hours absolute latest. Your company or a supplier acting on your behalf sold a contract and then retracted on a legally binding agreement. Cell C is required by law to provide the agreed deal or a deal of same or better value and worth.
I have already noted that a complaint has also been laid with the regulation authorities and I now intend to take this further to ensure Cell C is held responsible and made accountable for these lies and false promises.
